Fair Housing Act: What It Means to You Property managers have a great deal of discretion when choosing tenants based on their credit scores, criminal history, financial ability to pay, and rental history. However, this does not mean that landlords have carte-blanche discretion when choosing tenants -- there are limitations when making a decision. The federal Fair Housing Act, as well as local rules and regulations provides for protected classes of individuals, which cannot be discriminated against based on certain defined criteria. It is important to follow all laws and regulations when leasing properties to prospective tenants.
Title VIII of the Civil Rights Act of 1968 (Fair Housing Act), as amended, prohibits discrimination in the sale, rental, and financing of dwellings, and in other housing-related transactions, based on race, color, national origin, religion, sex, familial status (including children under the age of 18 living with parents or legal custodians, pregnant women, and people securing custody of children under the age of 18), and disability.
Prohibited Actions Property managers cannot discriminate against applicants for reasons of race, color, creed, national origin, sex, age, marital status, familial status, or physical or mental disability.
