My first thought was Hooray!!! Obama is coming to Mesa, AZ to make a great announcement and roll out a new foreclosure prevention plan and help stem the tide of foreclosures in Arizona and across the country. Short Sales will go away because people will finally be able to refinance their home and stay in the house, foreclosure rates will slow.

Zetabid, which bills itself as "the pioneering firm redefining home auctions in the U.S.," will sell approximately 200 bank-owned homes in the greater Phoenix area - including eight single-family homes in Chandler and five in Gilbert - on Sat., Feb. 21. The homes range from $20,000 to $800,000.

The number of homes that sold in Maricopa County in January 2009 was nearly 58% higher than in January of 2008 AND was nearly identical to the number of sales in January 2007!! January saw a 13% increase in the number of properties going under contract over December and compared to January of 2008, there was an increase of 61.8%! This was the best January we have seen in the 3 years of reporting period AND the best month since July 2008!

Arizona's Anti-Deficiency Statues , A.R.S. 33-729(A) and A.R.S. 33-722have been adopted by the legislature are intended so that a homeowner who is unable to make payments on a "purchase money mortgage" should lose no more than their home.
The Supreme Court of Arizona, in interpreting this intent, has held that a secured lender may not waive its security and sue directly on the note. I had the privilege to be invited to a presentation given by Dr. Jay Butler of ASU's Realty Studies on Wednesday December 3rd. Dr. Butler gave some very interesting statistics about where the market has been this past year. Foreclosures have been the hot button and amazingly foreclosure properties account for only 2% of the total of inventory in Maricopa County. That means 98% of the population is happy with their homes and comfortable with their payments.
