This is a follow up article to Florida legislative wrap up 2010 - Part 1.  Plenty of new laws are going into effect after this past session.
Here is a rundown of the remainder of what happened during the 2010 legislative session.  All laws are subject to the governor's approval or veto.
The Florida Department of Revenue has had conflicting rules regarding how much documentary stamp taxes are to be paid on a short sale transaction. It is already April and the Florida legislature has passed the half-way mark on the annual Spring session.  I will be joining the Florida Association of Realtors next week in their annual trip to Tallahassee to meet with state legislators and protect the real estate industry from higher taxes and more regulation.  This will be my second time going to Tallahassee.

The Florida legislature began their regular Spring session this week.  The biggest concern is of course the State of Florida's budget woes.  There are monumental shortfalls everywhere and the State is slashing and burning programs left and right while looking at all sorts of tax and fee increases.  There is a lot going on to say the least.
            
The Florida Association of Realtors ® has a great legislative tracking webpage, and I will be keeping up with them as best I can.  FAR's webpage.

On the same day that the Florida House passed a tax cut bill that looks to go nowhere, the Taxation and Budget Reform Committee has agreed to put on the November ballot a different tax proposal measure. 
The proposed constitutional amendment would make some radical changes to property tax bills.  The amendment calls for an elimination of the portion of the property taxes that pays for schools and in turn increases the sales tax.  For Realtors and real estate investors this is probably a great thing since it will most likely reduce the taxes paid via our industry. florida legislature: Florida House passes fantastic property tax reform, but in the Senate ... - 04/25/08 02:29 AM
On Thursday, the Florida House passed a serious property tax cut measure with votes basically split along party lines.  The Florida Senate however is a bit more reluctant and odds are high that the bill will not pass there.
  
The House bill follows the proposal of House President Marco Rubio's Cut Property Taxes Now group of limiting property taxes to 1.35% of the taxable value as set by the county property appraiser.  This measure would be a major tax reduction for non-homestead properties including landlords, snowbirds, and businesses.  The House bill would also provide for a revenue cap on government at all levels both state and local … (0 comments)

There are proposals being discussed right now to make sweeping tax reforms throughout Florida.  When the legislature is in session you never know what interesting ideas they might come up with.  Additionally this year Florida's Taxation and Budget Reform Commission is considering putting some amendments on the November ballot.
   
There is one bill that would eliminate the school tax portion of property taxes in return for a higher sales tax and an elimination of many sales tax exemptions (mainly on services - like lawyers, lawn mowing, haircuts, tax preparation, and yes real estate commissions).

The Florida legislature started their 2008 session this morning.  You never know what crazy things can get proposed when these guys get busy.
  Something I did like was that Governor Crist said in his opening remarks, "We can and should continue to fight for property tax relief and I encourage the Taxation and Budget Reform Commission to give the people the opportunity to vote for another tax cut."  That is good.  I am glad the Governor is keeping his word.  I did not have high hopes that this would happen.

Normally I would not post repeatedly on the same topic, but I consider this such a vitally important issue that I feel I must say something.
The legislature is wrapping up their special session on budget cuts this week and the word is that instead of calling a 4th special session that the Governor will be extending this session to address the property tax issue.
There is an article in today's Orlando Sentinel on the front page of Local & State that covers the Governor's proposed property tax issues.  I called Governor Crist's office this afternoon to find out what he is now proposing … (0 comments)

florida legislature: Florida legislature in session to enact budget cuts - 10/05/07 09:08 AM
The Florida legislature began a special session this week to cut $1.1 billion out of the state's budget.  This may sound like a huge cut, but considering that the current 2007 budget is some $73 billion it is really only a 1.5% reduction.  Big deal.
The Florida economy has slowed way down because Florida's real #1 industry GROWTH has screeched to a halt. (Tourism while touted as the #1 industry is really the #2 industry - growth being an industry just sounds really bad when a politician talks about it.)  The real estate developers and Realtors cannot get their properties moved for many reasons - problems … (2 comments)
