Last night at the Lighthouse Landlords association we had the fantastic opportunity to have Jerrett Brock from the Florida Attorney General's office speak to us for 2 full hours and do a question & answer session.  His presentation was loaded with lots of very pertinent information for Florida real estate investors, Realtors, and mortgage brokers.

Learn to help people negotiate a mortgage modification!  Or -- Help a consumer or even a Realtor negotiate a short sale!  I must get 10 emails a day for these type of services.  People pitching that they can teach you how to make big money negotiating mortgage modifications or short sales. Or people offering to negotiate the short sale for you and let you get back to selling properties. In fact a lot of Realtors and non-Realtors have jumped into these businesses in order to profit.

It sure seems like they do.  I completed my first short sale transaction back in 1999 with Option One Mortgage and even back then, it was a real chore.  After 4 months of waiting, I get notifcation less than a week before the foreclosure auction that the short sale was approved if we could close before the auction.  Ha ha!  My investor-buyer pulled it off.  But it was only then that I began learning how rotten dealing with short sales can be.

Yes this is a rant. 
I simply don't get this.  By now nearly everybody has gotten the word.  Short sales stink.  The process for so many homeowners, buyers, Realtors, title companies, mortgage brokers, etc. is often unbelievably long, frustrating, and painful.  And even when you do get the short saling lender to finally come back with a reply months later, the buyer has often given up and disappeared.  Why aren't the banks forced to use some of their TARP money to expedite short sales?

Whenever I take a buyer out to show properties in metro Orlando, the one thing that always stands out like a sore thumb is the number of properties listed as either short sales or bank foreclosures.   It seems like that in many areas that these listings make up 50% or more of the properties listed for sale.

A few weeks ago, I gave my "unofficial" opinions on this controversial new law that is now Florida Statute 501.1377 (formerly HB 643).  You can read the entire 14 page law at this link. Now some official opinions have come out on it.
