Last night at the Lighthouse Landlords association we had the fantastic opportunity to have Jerrett Brock from the Florida Attorney General's office speak to us for 2 full hours and do a question & answer session.  His presentation was loaded with lots of very pertinent information for Florida real estate investors, Realtors, and mortgage brokers.
The one thing he continued to hammer probably a dozen times was about upfront fees.  Florida Statute 501.1377 and the new Florida Statute 494.00296 are very clear in his opinion.  You cannot charge upfront fees for any transaction used to stop or avoid foreclosure.  Some of the … (3 comments)

Yes this is a rant. 
I simply don't get this.  By now nearly everybody has gotten the word.  Short sales stink.  The process for so many homeowners, buyers, Realtors, title companies, mortgage brokers, etc. is often unbelievably long, frustrating, and painful.  And even when you do get the short saling lender to finally come back with a reply months later, the buyer has often given up and disappeared.  Why aren't the banks forced to use some of their TARP money to expedite short sales?

orlando short sale: Second wave of foreclosures is coming - big time - 06/09/09 11:12 AM
This 60 Minutes bit has been around for a while, however many people still haven't seen it. Even though the real estate market does appear to have gained some steam recently with all the bailouts and the $8000 first-time home buyer tax credit, that still is not going to do much to prevent the continuous stream of foreclosures. These videos are very eye opening. If you aren't working the short sale and REO market now, after seeing this you may want to seriously consider positioning yourself into that market.

With the real estate market and general economy the way it is, more and more predators have come out from under the rocks.  Last year I blogged extensively on the Florida Foreclosure Rescue law FS 501.1377 that went into effect 10/1/2008.  This was Florida Attorney General McCollum's baby and since it went into effect he has been aggressively going after violators.

orlando short sale: Foreclosure and short sale homes are selling in Orlando - 03/27/09 12:02 PM
I can't say for sure if it because it is officially Spring time which begins our busy season or if something has turned in the marketplace.  What I can say for sure is that properties are selling.  Sales are up and things are busy.  Our foreclosures and bank REO listings are often getting offers within just a few days and some are going with multiple offers.  Our short sale listings are getting approved reasonably quickly compared to what they were even just a few months ago.  The contract assignment deals are moving too - investors are buying in droves.

According to statistics released by RealtyTrac and the Orlando Sentinel, Florida is the #2 state in the USA and Orlando is the #7 metro area in the USA for foreclosures being filed.  Whether you like them or not, short sales and foreclosures are here to stay for quite a while.   The trend doesn't seem to be slowing down one bit.

I am glad a few people did take my advice and try to get some great year end deals.  Banks love to unload properties before a fiscal year end, and some buyers really got some steals in December.

orlando short sale: Florida attorney general issues opinion to Realtors(R) on the Foreclosure Fraud law FS 501.1377 - 11/12/08 08:28 AM
Florida Attorney General Bill McCollum issued an official opinion to the Florida Association of Realtors(R) last week regarding the Foreclosure Fraud law a/k/a FS 501.1377.
Basically what it boils down to is that real estate brokers and associates who are listing properties, negotiating short sales with lenders, and getting paid a commission at closing are fine as far as the AG is concerned.  Of course a court might just rule differently but hopefully not.
