We just closed a Bank of America short sale in Panama City, FL
First mortgage amount: $200,000
Second mortgage amount: $40,000
Sale price:  $185,500
lender agreed to pay $5500 for buyers closing costs, title insurance, doc stamps on the deed, tax prorations and 6% commission (one agent involved)
Net amount to BofA:  $164,730.40
Seller did not contribute to the sale, no promissory note.
Time Frame:  File submitted on 6/18/09, property closed on 7/27/09***
This was the second buyer, the first walked on 6/17/09 and we found a buyer the next day and resubmitted the entire package and closed in 40 days!!!!!!!

There has been alot of talk lately on AR about short sales and whether or not agents should be negotiating short sales or should attorneys handle the short sale?
My first response is that laws can vary from state to state.   HOWEVER, agents are NOT or at least the SHOULD NOT be negotiating short sales.  The short sale is not any different than a normal sale contractually, the contract is between the buyer and seller and the agent can not do any negotiating for the buyer or seller, they are advising the buyer or the seller and can NOT make those decisions … (6 comments)

I thought that I had heard every excuse in the book for the banks lack of responding to a short sale request. 
Can't find the authorization Did not recieve the package... I actually had one tell me "Sir, we did not recieve your 44 page fax." We are waiting for a negotiator to be assigned We ordered another BPO, we did not like the value on the first one Our fax can not handle more than 10 pages at a time We are awaiting investor approval I could go on an on... I have been trying to get a negotiator assigned to a Gennie Mae short sale file at Countrywide since December 2008.   The file got kicked out of the system because CW thought it was an FHA loan and found out that it is a Gennie Mae loan. Since then, this file has been sitting and not moving at all.  I call frequently and have no luck getting this assigned.
Does anyone have a good contact at CW who may be able to escalate the file.  They already did the appraisal and BPO but I am sure it is too old by … (3 comments)

We just closed another short sale and saved another seller from a bad situation.  Everything went just as we planned, contract to close in just over 60 days.  The seller WAS NOT behind on his payment but had a hardship that qualified him for a short sale with his lender.   The seller had a VA loan and his credit was critical due to a security clearance with the military.
The VA accepts 82% of the appraised value for their NET and DID NOT CUT THE COMMISSION.

Be aware of short sales and option contracts!!!!!!!!!!!!!!!!!!!!!!!  Be very careful. 
We recieved an offer on a short sale in July of 2008, this was an option contract for a specific price that was very low.  The buyer would have his company negotiate the short sale and once we landed on a settlement that was acceptable to the buyer and the lender, we would find another buyer and the original buyer will make a profit.  Sounds good on the outside.......

Just curious if anyone has any luck with Taylor Beach Whitaker on a short sale.  I have a short sale package submitted and they person that I talked with was very optimistic telling me that they will have an answer in 45 days.  Not that I doubt her, I sure hope so!!
My big problem is that they are SO difficult to get in touch with.  Everytime that I call I can expect to be on hold for at least 30 minutes.  Anyone have a number other than 1-800-530-2602

I am amazed when I see the banks process for disposing of REO and short sale properties.  They just don't seem to get it!   They wrote a bad loan, now they need to face the music.   The financial system is on the brink of disaster and foreclosures and short sales are the norm in most markets.  
I have negotiated numerous short sales and have sold many foreclosures.  The loss mitigation departments are super busy and need more help and better systems.  They are not equipped to handle mass business, one huge company that I have dealt with still uses regular fax … (6 comments)

I just got an approval for a short sale, providing the seller sign an unsecured note.   Here are the details.
The offer was for $165,000, normal closing costs paid by each party.  The BPO came back at $170,000 and the home has been vacant for several months.  The lender claims that they are OK with their NET amount but the Private Mortgage Insurance Company wants a $67,000 unsecured note paid over time.   The seller has no money, they can't even pay their monthly expenses without this mortgage, they are FLAT BROKE and their financials show it.  A job loss and relocation … (9 comments)

Wow, after all of the bad WAMU short sale blogs that I read, I thought I was in for a long and drawn out process.  We recieved a contract and submitted to WAMU and they ordered the appraisal immediately and give us a reasonable counter offer.  We closed in less than 30 days. The only part that got scary was when their closer took forever to approve the HUD-1 Are the banks starting to pay attention to their loss mitigation departments?????

This is a question for the short sale experts here in Active Rain.  When you submit a short sale package on a property with a first and second mortgage, how much are you offering the first mortgage and how much are you leaving over for the second on the HUD-1?  I have been putting 90% of proceeds to the first and 10% to the second.  I just got a first approved and they approved the sale with only leaving $1500.00 for the second mortgage.  I now am faced with the task of getting the second to settle for $1500.00 which is … (28 comments)
