When dealing with short sales and earnest money, it is important for agents/brokers to be clear about the procedures that impact the handling of earnest money. A common phrase I see in offers is that the agent/broker writes 'earnest money will be deposited upon approval by the seller's bank.' A couple of notes about this statement. One is that the approval by the seller's bank is completely independent of the rules for handling earnest money. Combination lockboxes are widely used to hold keys for foreclosure listings. And their use has studily increased over the last five year with non foreclosure listings. I see combination lockbox codes posted in the MLS remarks section. I call agents who have no problem giving out the combination lockbox code to me without prior identification from me as a real estate professional. Ummm...
