condominium: Condo Renters: A Potential Asset - 11/30/16 03:17 PM
Question. We have been renting a condominium unit in a fairly large complex for the last several years, and our current plans are to stay here for several more years. For financial and other personal reasons, we do not want to buy. However, quite frankly we feel we are second class citizens in this condominium complex. We recognize we cannot serve on the Board of Directors. However, we want to get involved in various condominium activities, including the budget, grounds and maintenance, and a newsletter, but the Board is adamant against our involvement. We believe we can be more productive for … (0 comments)

condominium: Condo Owners Can Speak Freely - 09/28/16 02:34 PM
Question: We live in a large condominium project, and a number of us are quite concerned about our Board of Directors. We are not permitted to attend their Board meetings, we have tried to get copies of the financial statements without success, and we suspect that at least one of the Board members is getting kick-backs from the various contractors that are hired to do work at the project.
The current Board will continue to serve until next April when there will be an annual meeting and another election. Many of us are interested in having a recall of the Board, but … (2 comments)

condominium: So You Want To Purchase A Condominium Unit? - 04/25/16 11:11 AM
Condominium sales are hot throughout most of the country. People want the advantages which a condominium can offer -- such as not having to shovel snow, cut the grass or worry about making arrangements for maintenance and repairs.
But before you buy, you must do your homework. It is not the same as buying a single family home. All condominium associations have rules and regulations which must be honored by all owners; all associations have budgets which may or may not be adequate.
State laws differ as to whether potential buyers are entitled to receive certain information -- before they go to closing … (2 comments)

condominium: Condo Owner's Bill Of Rights? - 11/17/15 12:26 AM
D.C. Councilmembers are studying a controversial measure that would provide new protections for condominium owners.
"While protections already exist for owners governed by a condominium association, conflicts often occur, including misunderstanding of rights or inequitable implementation of an association's policies and penalties", said District Councilmember Anita Bonds as she introduced the "Condominium Owner Bill of Rights". "These situations are particularly egregious when condo boards foreclose against their members as a result of past overdue assessments. Co-sponsored by Councilmembers Mary Cheh, Yvette Alexander and David Grosso, the bill if enacted would do three things.
First, it would require mediation before a board can foreclose … (0 comments)

condominium: Combining Two Condominium Units - 10/23/15 07:16 AM
Question: I currently own a one-bedroom condominium unit. My next door neighbor has offered to sell me his unit, so that the two units could be combined into one larger unit. In all likelihood, I will initially move into the new unit as my primary residence and rent out the one in which I presently live. However, in the future, I plan to make improvements and do construction so as to make them into one large unit.
When the two units are combined, will I have to record the lot or title change with the recorders office? Will I have to refinance … (0 comments)

condominium: Upper-Unit Hardwood Floors Pose Condominium Problems - 09/14/15 09:41 AM
People who purchase a condominium unit that has another unit above it are liable to be concerned about the potential for noise coming from the upper unit. It is a legitimate concern and one that is not assuaged simply by being reassured that the current occupants of the upper unit are quiet and considerate. What about future owners? What if someone installs hardwood floors? You want to know if the association CC&Rs (Covenants, Conditions, and Restrictions) provide any protection from such a situation. If they do, the courts will enforce them.
In February of 2011, Ruben Munoz, an attorney, and his wife … (0 comments)
