      <description>I appreciate this website for clarifying the three times that the new 3-day reviews start over for closing disclosures.  I needed this.       <title>Bank forecloses, changes locks and evicts Family. Family changes locks back and moves back in. </title>
      <description>If you haven't heard this story yet, you've got to watch below. It's crazy. And it's gutsy. This family gave the bank a taste of it's own medicine--so to speak.
It's also a classic example of why there is a moratorium on foreclosures with some banks. You know-- robosigning. The last thing banks want to add to their expense sheet is another lawyer. There will be lawsuits galore. I think we may see something very new-- foreclosure reversals. Not many, but there will be some worth telling about.
Keep in mind these kinds of stories may make banks or lenders more inclined to sell properties before foreclosure through a short sale process.
Sooooo, if you know someone in the Henry County area facing foreclosure, let me know. I'll try to help. Short sale may be the best way to avoid these kinds of nightmares.
Watch below. It is very interesting. They've already coined a new word--fraudclosure.

      <title>What do you guys think about donating prosthetics for Haiti Relief?</title>
      <description>The
beautiful thing about living in  Henry County is that you
always know somebody who can find out just about anything you can dream
of.
The
other morning, I heard Taylor from a 104.7 FM (The Fish) says that
she and her husband were wanting to find a prosthetics-centered charity
to donate to for the Haiti Relief effort. I thought that's it. That's
how I want our family to help in the Haiti Relief Effort--donate to a
prosthetics-centered charity.
That
afternoon, while sitting in the carpool line I saw the mother,
(Paige Spratlin) of a double ampute girl, Adanech, walk by. I asked her
how I could find that out, and, ....well she got right on it. She
called her provider of prosthetics, Hanger Orthopedic Group, and they
had just released this press release.
Apparently,
we  were not the only ones with this idea.
So,

Orthopedic Group to Donate $250,000 in Funding and Orthopedic Devices
to Haiti
Earthquake Relief Efforts

Hanger Orthopedic Group, Inc. (Hanger) and its philanthropic
organization The Hanger
Ivan R. Sabel Foundation announced today that it will provide $250,000
in
funding and orthopedic devices to assist with the medical needs of
those
affected by the earthquake in Haiti.
A
direct cash
donation of $25,000 and a contribution of $225,000 in orthopedic
devices, including
neck and back braces, limb immobilizers, fracture boots, wrist splints,
and cervical
collars, will be donated to two charitable organizations currently
providing
care in Haiti – Physicians for Peace and Project HOPE (Health Opportunities for People Everywhere).
“We
feel deeply for the people affected by this profound
tragedy and we hope our contribution will help ease some of the
suffering,”
Hanger President and CEO Tom Kirk
said.  “As
the largest provider of
orthotic and prosthetic patient care, we see firsthand everyday the
hope that
can be instilled by restoring mobility and functionality to those with
severe
orthopedic injuries.
We will continue to
work
with
Physicians
for Peace and Project HOPE, as well as other non-profits, to define the
clinical need and the logistics to provide care and services in Haiti.”

      <description>Here comes the sun, yadadaadaaa, here comes the sun. Last week I wrote about how why we close when snow comes to the Atlanta area--because we southerners have no business driving on icy roads and we don't have the equipment to get sand and salt on all the roads that need it.
Now we are fixing busted water pipes and sorting through auto accidents. While we were bundled up in our homes (with our milk and breead, of course) we watched the local TV stations for schools closings. I got to thinking. What if we only allowed certain drivers to drive while roads were icy. Say, your insurance rated you on your ablility to drive on icy roads.
Class 1--you have lived and drived in North Dakota for 10 years
Class 2--you have lived and drived occassionally on icy roads in Tennessee for 5 years
Class3--nobody in your family has ever lived north of Atlanta and you think snow means "vacation."
Instead of school closings on the TV station crawler, you would see what class of people get to drive. Class 1 can drive as they wish. Class 2 can drive only on major roads that have been treated with sand and salt. And Class 3, well, you have to wait until everythng has thawed.
Insurance companies could require you to sign up for the twitter feed to tell you when you could drive if you didn't have TV.
This is all tongue-in-cheek. I would be in class 3. Watch the video. What do you think?

Now, look at the pending or under contracts report below. There's a glimmer of hope for homes priced in the $350K to $400K. I'll be looking that up to get the scoop on that. For now, it looks like a particular neighborhood may have had a great sale.

Okay. Now, look at the inventory below. Again the $100K price range is where there is sales activity, but also where there is some competition. You can compare these figures for the Woodland School District to an earlier post that has the same figures for all of Henry County, GA.

      <description>We knew there was a possibility of snow probably 4 days ago and now it may have arrived. I don't know for sure. But, I did just get an email with the announcement that Henry County schools have cancelled all practices and after-school athletic activities. &lt;img src="https://activerain.com/image_store/uploads/6/1/1/6/2/ar126288734826116.jpg" style="float: right;margin:1px;"&gt;
That sounds silly to people who have spent any part of their lives up north where snow is just part of every-day life. So if you're one of those people who thinks it's hilarious that we southerners shut down because of a snowflake let me explain.
We don't have the road equipment to deal with any icing of roads. It doesn't make sense to spend our tax-payer dollars on road equipment we MIGHT use once or twice a year if we use it all. Besides that fact, do you really want people who have no experience driving in ice in snow on the road? Do ya?
Yeah, we will probably shut down if there is any significant snowfall. We will be all snuggled up in our homes thinking about the beach.</description>

      <description>Based on the reports below you will see that homes priced below $100K are the ones that are selling. Homes in that price range usually are foreclosures. But that inventory is dwindling a bit. That price range is the one to watch. Once the inventory at that price point is dried up, we should home prices start to recover.
If the job market shows any signs of recovery soon, you can start to look for those "green shoots."

My conclusion after this experience with the VA Vendee loan program has been that it is typical of other 1-800 or other internet-based lenders. You as an agent or as a buyer or both of you are going to have to to follow-up and follow-up some more. It's a loan program  offered through a Bank of America call center in Texas. You will not get the same service as you will from a reputable local lender.
You will find little information regarding this program on the internet because there are very few home buyers using this loan program. There are very few home buyers using it because it is a very difficult process. Hence, the long and lonely road.

The closing was a great mystery. There were no answers from the loan originator. There were no answers from Bank of America. The loan processor for Bank of America demonstrated repeatedly that she knew very little about real estate transactions. She asked me several times if she should order title? Yes, yes, yes. Then she asked if she should arrange for closing. YES!! YES!! YES!! I gave here names and numbers galore for a closing attorney.
NOTHING.
After many many phone calls and emails we finally find out that she didn't know she was supposed to use a title company contracted by the VA for VA Vendee loans. That title company was Service Link, which is a the closing service for Fidelity National.
How can a loan processor not know this? She kept asking me what she should do because she was getting no answers from her own company. She even told the listing agent that she couldn't let her know the status of the buyer's loan because that was private. WHAT???
Well, Service Link finally gets the package together from VA Vendee/Bank of America, sends an attorney to my buyer's workplace to have her sign the loan papers, and declares the transaction closed. (The attorney first shows up with completely wrong papers.)
NOT.
More than two weeks after closing my buyer and myself had to scream in emails and phone calls to get her copies of the loan papers. She was left with none. The closing coordinator thought the B of A loan processor would take care of sending them and vice versa. Finally, they sent them.
Two months later my buyer has to jump up and down to get a copy of the warranty deed, which 2 months later was still not filed. Oh, because it wasn't signed and notarized at closing.
This is what you get with Service Link, an attorney who at first shows up with the wrong loan docs, then doesn't make sure everything is signed properly.
Did I mention the HUD had many mistakes?
Beware of Service Link. Watch them like a hawk. It was later revealed that this sloppy closing was one of their firsts with the VA Vendee program and that they genuinely cared about these details. They did finally take care of the mistakes on the HUD, the copies of the loan papers, and filing the warranty deed. But, it was only through prodding.
Perhaps there are success stories out there of "smooth as butter" transactions with VA Vendee. Perhaps now, they have worked out the kinks.

To back up a bit let me first explain that my buyer insisted on using this loan program in the purchase of her home in a nearby county. She was very insistent on getting this loan.
If you are an investor, and you want to explore this loan program, below are a few points to consider when shopping for loans so that you can snap up the bargains that are waiting for you out there.
You don’t have to be veteran to qualify for the VA Vendee program.
It is available only through Bank of America.
You do have to purchase a VA Vendee approved property
Can be financed for as little as 5% down Investors must have experience managing rental properties to include anticipated rent on subject property in underwriting—you will need to call to see what qualifies as enough experience
There is an appraisal unlike the owner-occupant VA Vendee loan which does not require an appraisal.

Am I promoting this loan program? Not really. Just sharing the information that I found. Going through this loan program with my buyer was not all roses as I said in the first post. There were definitely some frustrations along the way. They said she was approved and then later said no she wasn't approved. And finally, she was approved. She got a very competitive rate minus a few strands of hair. In the end good things come to those who are patient.

      <description>Well, there's no shortage of something new to learn in this business of real estate. When my buyer informed me that she had already pre-qualified with the VA Vendee program and that she was absolutely certain that was the loan she wanted, I was very leary. What you will read below is what I wish someone had told me straight from the beginning. It was a long and lonely road. &lt;img src="https://activerain.com/image_store/uploads/1/2/3/6/0/ar125736403606321.JPG" style="float: right;margin:5px;"&gt;
And of course I did what any other agent would do. I googled "VA Vendee." Then, I did what Margaret Woda recommends. I searched AR (or activerained) the term VA Vendee. I found more questions than I did answers. It seems there is little experience with this program. Below are my conclusions--short, sweet and to the point.
This program existed in the 70s and 80s, went away and is back again.
You must get pre-qualified through Bank of America.
You must be purchasing a VA-owned property that is eligible for the VA Vendee program. (I'll talk more about finding those properties in Part 3)
Any purchaser can apply for Vendee financing. You do not have to be a veteran.
Vendee Financing is available for owner-occupant and non-owner occupant. (I'll talk about the investor side of the loan in Part 2)
The rates are extremely competitive. My buyer's rate was below 5%. I can't quote exact rates here.
There is a 2.25% funding fee you must pay.
Here is the kicker--NO APPRAISAL is required for underwriting.
That's right. You don't have to worry about an appraisal ruining your deal. And these days, appraisals are of the devil (so to speak). I've heard some very sad stories about how appraisals are ruining deals recently and I'm sure you have, too.
A few more interesting points are listed below:
No down payment is required.
The loan amount may be increased up to 2% to finance closing costs, prepaids or other expenses.
The VA (the seller ) may contribute up to 6% of the contract sales price to pay for the funding fee, closing costs, and pre-paids.
Vendee mortgages are available in 15-year and 30-year terms.
Vendee mortgages are assumable.
Vendee closing was extremely unique. (I'll talk about that in the upcoming Service Link post.)
Vendee financing is not a credit score driven product. What????
Yeah, that 's right. It's not credit-score driven either. I'm sure there are many factors taken in to consideration, but I didn't find those requirements in my research.
It is a great loan product. However, it is only available through Bank of America.

      <description>Are we headed to a buyer's market in Henry County, GA?  I think so.
Are we there yet? NO. But we will be at this time next year if buyers continue buying at the same pace they are buying now and listing inventory continues to shrink.
Housing inventory in Henry County has fallen almost 40% since a year ago. About a year ago, there were roughly 3300 single-family homes for sale in Henry County, GA. Today, October 14th, 2009, there are only 1993 single family home listings. We went from about 3300 to 1993.
Are you going to kick yourself later for not buying?  Good question.
Look at this chart showing the number of new listings from 2008 to 2009, month over month.
