What do dogs, cats, song birds, chickens, rabbits, and turtles all have in common?  A second chance provided by the Marin Humane Society ("MHS")! 
MHS turns 100 this year and is celebrating that milestone on June 3rd with festivities for all ages.   There will be contests (e.g., biggest dog, smallest dog, best dog singer (like American Idol?), demonstrations, a group dog walk at 10:00 a.m., drawings, and more.

Defying national and statewide trends, the Marin County real estate market posted strong numbers in both sales and prices of homes sold in April 2007.  As reported in the Marin Independent Journal ("IJ"), homes sold last month for a median price of $1,010,000 according to figures compiled by DataQuick Information Systems-the first county in California to have a median price of $1 million plus.

Novato home sales and real estate values are proving to be somewhat sluggish as we enter the Spring selling season. Novato's homes that are nicely maintained, updated, and/or located in the most desirable neighborhoods continue to sell at a relatively quick pace (especially those priced under $700,000. Once prices get up above $700,000, however, the percentage of homes in escrow (a good barometer of market strength) dips to about 25%.

The number of homes for sale (inventory) continues marching upwards--countywide, there are 647 active listings (up from 549 active listings this time last month). The high point (in terms of the sheer number of homes for sale in Marin County) will likely be next month. While the number of homes for sale has gone up, it is still very low historically (especially in Greenbrae, which has only 8 active listings).

The level of inventory for single family homes in Novato (North Marin County) has increased steadily over the past several months.  As we get settled into the peak buying and selling season in Marin, Novato leads all other Marin towns in homes for sale with 173 (active listings).  There are 66 properties currently in escrow.  Twenty-seven homes in Novato sold this month as of 4/28/07.

Below is a rudimentary outline of some common terms encountered when conducting 1031 exchanges.  These are just guidelines.  For nuanced definitions, contact your attorney and/or accountant.
Boot -- property that is not "like kind" and taxable (if there is a gain)
Cash Boot -- proceeds actually or constructively received by the exchanger
Constructive Receipt -- a taxable event where an investor does not maintain actual possession, but is entitled to proceeds which are being held by an agent or other entity/person in a fiduciary manner
Direct Deeding -- title goes from exchanger to buyer and from seller to exchanger upon execution of all docs

Overall, the market in Novato is gathering momentum.  There are currently 155 active listings (single family homes) for sale (up from 126 last month).  About 1/3 of those are priced under $750,000-making Novato a desirable option for buyers priced out of Central and Southern Marin.  Indeed, 20 of the 40 homes that sold in Novato during the past month were priced at or below $750,000.  By comparison, Mill Valley, at the time of this writing, has just one listing under $750,000.
