foreclosure: The Real Reason Banks Won’t Modify Your Loan and It Involves Grandma’s Pension - 05/21/10 09:10 AM
I began working on this project last year at the peak of the modification frenzy and finished it about a month ago.  I originally planned on posting it last week on the eve of the Mortgage Servicers Convention in Dallas.  I decided hold off because I didn't want to ruin the fun of the champagne fueled Conga lines or the Mad Men style skirt chasing that usually goes on at conventions sponsored by the financial services industry.
The findings of my year-long investigation would have put everyone into a panic mode and stopped the flow of the Dom Perignon for the Conga lines … (2 comments)

HUNDREDS OF THOUSANDS OF HOMEOWNERS ARE BEING
ILLEGALLY FORECLOSED ON BY THEIR LENDERS
West Palm Beach, FL-MFI-Miami, LLC, Florida's premier forensic mortgage fraud investigation and mortgage auditing firm is warning consumers facing foreclosure that the lender who is initiating the foreclosure action against them may not have the legal standing to do so. This also means the mortgage servicer may not be legally able to accept payments or negotiate a loan modification.
"It boils down to simple Real Estate 101," explained MFI-Miami CEO Steve Dibert, "If you don't own the note, you can't sell it, modify it or enforce it." … (0 comments)

foreclosure: White House Mod Proposal: Political Illusion or Act of Self-Preservation? - 11/16/08 01:55 AM
There has been a lot of talk over the past few days about the new proposal by the Bush Administration to help stabilize the housing market by encouraging banks to modify loans for at-risk homeowners.  The plan is to secure 31 million mortgages worth approximately $5 trillion which were underwritten by Fannie Mae and Freddie Mac and prevent them from going into default.  The federal government took control of Fannie Mae and Freddie Mac in September when waves of foreclosures resulted in mounting losses on their portfolios.  The Bush proposal mirrors what Citigroup, JPMorgan-Chase, and Bank of America have already been … (0 comments)

foreclosure: 10 Questions You Should Ask a Loan Modification Company - 11/04/08 11:34 PM
There is a new industry rising from the ashes of America's imploding mortgage industry and it's called Loan Modification.  Loan modifications have become a viable option for many distressed homeowners many of whom are considering abandoning their homes because they are upside down in their mortgages or just simply can't afford their payments.
What is a loan modification?  A loan modification is as the name suggests a modification of your current loan without going through the process of refinancing our home or property.   The responsibility of a loan modification company is to act as a negotiator for you with your lender.  … (4 comments)

foreclosure: Have the FBI and the American Homeowner Been Bushwhacked? - 10/26/08 12:44 PM
What would you do if one night after a long day at work you came home to find your house ransacked and that you had been robbed? Now, what would happen if you called the police and no one came to investigate or were told to call someone else?  You would be shocked and dismayed.   Don't think this could happen? It already is happening and it's not just you, it's happening to your neighbors and friends as well.  The thieves are getting away with millions of dollars and the Bush Administration is allowing it to happen.

foreclosure: WARNING:YOU COULD STILL FACE FORECLOSURE AFTER A LOAN MODIFICATION - 10/19/08 12:13 PM
Since beginning MFI-Miami, I've seen a lot of mortgage servicers attempting to foreclose on homeowners without being able to prove they are the proper custodian of the note or mortgage.   I have one client right now who is beginning litigation against American Home Mortgage Servicing, Inc. partially because they can't provide proof of the transferring from Option One Mortgage Corporation or from the original lender.   I have another client whose foreclosure was cancelled (with MFI's help) by Bear Stearns because they could not prove the transfer even happened.   I could go on and on by listing other clients I've had. However, … (3 comments)

foreclosure: Having trouble with your Short Sale, Loan Modification or Foreclosure Bailout? - 09/16/08 12:36 PM
Is your short sale or loan modification deal seem like it's dragging on and on?  Is the lender not responding to your inquiries?
That's because in today's real estate atmosphere, lenders and banks don't want to hear about a customer's personal tragedy.  They're more interested in covering their back and their survival.  You and your client need to show you have the upper hand to force the lender to the table. You arm your client with a Forensic Loan Audit.  Lenders hate dealing with me! Why? Because I find errors and fraud in nearly 75-80% of the audits I do.  I expose the dirty little secrets of … (0 comments)
