Most of the information distributed about Senate Bill 458 has been focused on junior lien holders and doesn't mention one of the other big highlights of this bill for people who are short selling. It appears many REAL ESTATE agents are unaware of new ruling by the FTC and the $11,000 fine associated with not following it. We have received many questions over the last couple of weeks regarding the new MARS (Mortgage Assistance Relief Services) Ruling passed by the FTC to protect consumers and curb unfair and deceptive practices associated with mortgage assistance relief services.
Information regarding this law can be found on the FTC Website. The new ruling states that Real Estate Professionals can be fined $11,000 if they do not use the disclosures on marketing materials related to helping homeowners in "distressed" situations.
