moving day drama: Dueling Pianos. . . Can a Baby Grand Delay Closing?
- 08/08/18 07:53 PM
My clients and I were on the hunt for a home large enough to accommodate their baby grand piano. After viewing a dozen or so homes, we found "the one". We knew it would accommodate the piano because the seller already had one in the formal dining room. The offer was written and accepted. My clients house was under contract so this would be a back-to-back closing.
Things got interesting on closing day. . .
At 8:00 a.m. we learned that the sellers daughter couldn't pick up the piano before closing. No worries; my clients said they could pick it up later in the week. A piano mover was scheduled for 9:00 (18 comments)
moving day drama: Possession is Determined by the Sales Agreement

The real estate contract usually has a clause that dictates when closing and possession takes place. My understanding of what is "typical" varies in different parts of the country.
This is evident when someone expects to automatically receive a certain number of days to vacate after closing. Some sellers exclaim they had 30 days to move in certain parts of the country and that was routine. Others mused they were previously allowed three days after closing to move.
Unless it is spelled out in your sales agreement, possession transfers with closing. Our Mississippi contract gives two options:
1) Possession shall be delivered to Buyers at closing (7 comments)
