Things that every REALTOR® working hard to find a home for their buyer clients first read before laughing at it and tossing it in the shredder. "What doesn't kill you will just make you Stronger!" That's what my grandfather taught me. He used to heckle anyone, anything, anywhere and anytime.....maybe that is why I am now a heckler. I'll give you a few examples: 1. I'm at the movies, with my wife, during the opening week of one of the Lord of the Rings movies and at the part where the hobbit creature is sitting atop of a tree, as it's racing down to save all the other trees in the forest......the theater is quiet, the music dramatic, and I yell ..."RUN FOREST, RUN!". Imagine hysterical laughter for the next 10 minutes as trees are running around everywhere trying to save their world. 2. I'm at a minor league baseball game. The home team is down by two runs in the 7th inning and up to bat in a tough game. The visitors put in a relief pitcher to start the inning and I start yelling...."Pitchers Got a Rubber Arm!" or "We Want a Pitcher not a Belly Itcher!!"....childish, yes or course, but after four relief pitchers, bases loaded in the 7th, 8th, and 9th innings, AND THREE runs later, the home team wins. Was it me? Or just good baseball? And Lastly.... 3. I'm in my office going through the MLS reading the showing instructions: "Can only be shown on Saturdays from 1 - 3 pm", "Tenant requires 1 week notice (or more) to show, because they are uncooperative.", "Owner having personal difficulty with sale of home, drive by only", "Out of Area Agents must call for access. (FROM AN OUT OF AREA AGENT WHO IS NOT USING A LOCAL LOCK BOX).", and my favorite, "Don't call me for any reason I will not take your call." If these are your showing instructions, I don't mean to be insensitive but, I WILL PROBABLY HECKLE YOU! It might be in the privacy of my office, over the phone, or maybe even in person. I don't intend for it to be mean, but C'MON! If just getting in to show your listing is this big of a deal, it's just a guess, (and I REALLY hope I'm wrong) but it seems like YOU are probably going to be a PAIN IN THE ASS TO WORK WITH for the next 30-45 days, but hey, what doesn't KILL me will just make me stronger! Here are 10 things I hear over and over. "If the bank does foreclose, my parents will buy me another one." "I don't care if what I'm doing is illegal, everyone else is doing it. My friend (neighbor, relative, friend of a friend) did it this way, so why can't I?" "I CAN afford my mortgage payment, I am just choosing NOT to pay it." "It's just not fair that the house next door sold for $200,000 less than what I paid for mine." "I Just Went Through a Foreclosure...When Can I Buy My Next Home?"

I keep getting asked, "I just went through a foreclosure, when can I buy my next home?" What IS the "time table" for past and current homeowners who are currently going through or have gone through foreclosure, short sale or BK events over the last several years? I've asked a loan officer from a direct lender : "Well, whats the story?", and this is what they're saying. If you live in the Menifee, Temecula or Murrieta, California areas, and you've gone through foreclosure, short sale or BK events in the last 2 - 4 years CALL ME TODAY! Let's see if you may be eligible to qualify to purchase your next home. Eligibility CHART after foreclosure/BK/Short Sales** FHA Chapter 7 - 2 years after date of discharge with re-established good credit. Chapter 13 - minimum 1 year pay-out to court. All payments paid as agreed and court must approve transaction. Foreclosure/ Deed in lieu - minimum 3 year period after trustee sale. If defaulted loan was FHA loan then it is extended to 3 years after CLAIM paid to lender. Must contact FHA office for that information. CAIVRS must be checked for clearance by lender to ensure eligibility as well. Short Sales - There are 2 scenarios to consider: 1) Extenuating Circumstances due to borrower job loss, illness, mandatory employer relocation. As long as circumstances can be documented and all mortgage payments and other debts were current at time of sale and transfer of title to new owner, FHA has no restriction on "waiting" period to purchase a new home. Divorce is not considered an extenuating circumstance under most cases. 2) For any other situation where borrower was delinquent - 3 years after sale and transfer of title to new owner. VA BK 7 - 2 years with re-established good credit. BK 13 - minimum 1 year pay-out to court. All payments paid as agreed and court must approve transaction. Foreclosure/ Deed in lieu - minimum 2 year period after trustee sale. If defaulted loan was VA, there is a good chance entitlement may be "used or tied up" and veteran may no longer be eligible for VA financing. CAIVRS must be checked for clearance by lender to ensure eligibility as well. Short sales - minimum 2 year period after sale and transfer of title to new owner. Conventional: BK 7 - 4 years (48 months). BK 13 - 4 years (48 months). Multiple BK's last 7 years - 5 years (60 months). Foreclosures - 59 months. Foreclosures - between 60-83 months - primary residence only - no refi - 680 fico - purchase only - 10% down no gifts. Deed in lieu - 47 months. Deed in lieu - 48 - 83 months - primary residence only - no refi - 680 fico - purchase only 10% down - no gifts. Short Sales - there are 2 scenarios to consider: 1) Extenuating circumstances - 2 years after sale and transfer of title to new owner ONLY if due to job loss, illness or mandatory job relocation (divorce not considered extenuating in this situation). Purchase only - owner occupied - 680 fico - 10% down - no gifts. 2) Any other situation is considered as "financial negligence" and borrower must wait 4years after sale and transfer of title to new owner. ** Keep in mind that this information is applying to conforming loan amounts for all categories so if the loan is considered a jumbo or NON- conforming loan, the restrictions in some areas may be greater. ( RIVERISDE / San BERNARDINO counties for FHA has their conforming max at $271,050 even though lenders are able to lend up to $500,000). The FHA conforming loan amount for LA, Orange and San Diego counties is $625,500, although their loan amount ceiling is higher. ** Lending eligibility requirements may vary from area-to-area and/or state-to-state, and are subject to change without notice. This is about the year there was no Mother's Day, a story of a mother who went on strike! My wife raised 5 kids "Brady Bunch style" for 18+ years, while I was deployed 6 - 10 months at a time every 2 - 3 years over a 20 year Naval career. Before e-mail I would get letters that were 2 - 3 weeks old telling me about the trials and tribulations of being a "Navy Wife" having to raise so many on her own. One Mother's Day, when the kids were older, I was overseas, a dozen roses I ordered for her showed up. Even with my wife dropping hints to the kids all week about "her" upcoming Mother's Day, they had still some how forgotten...OOPS....that was the year my wife went on Strike! Imagine 5 teenagers, no mother...at least a mother who was on strike! I, like all her co-workers thought this was the best lesson they could have ever been taught. Daily updates on the status of her "strike" couldn't come through the mail-bag fast enough. No home cooked meals, no laundry, no rides to the mall, NO NOTHING! In order to end the strike all she asked was that each one of them wish her a happy Mother's Day WITH an apology for forgetting about "her day". Now I know I can be stubborn, and with peer pressure from all of the kids, the oldest finally made his apology 4 weeks later. Strike Ends! Yeah! I know that Mother's Day is tomorrow, but I think moms out there need more than just ONE day of pampering and being thanked! I for one am horrible when it comes to being romantic and putting work down for a day and remembering what is most important. (In fact I am working right now typing this into my blog.) I want to wish my wife a "VERY HAPPY MOTHER'S DAY!" for raising 5 terrific kids, I love you for all that you do. And also a Happy Mother's Day to my daughter for giving us the most beautiful grand baby we could have wished for. Another Day - Another Scam. Jury Duty Scam Sweeps Nation.

I just wanted to help get the word out regarding the latest Fraud affecting our area. Jury duty can be painful enough, but this little ploy could make it even more painful if you're not careful. Big thanks to Gene Wunderlich for forwarding this information on. Our Riverside County Joint Fraud Task Force has adopted a new motto - 'Changing Times - Changing Frauds'. When we started five years ago we were primarily focused on mortgage fraud as that was the predominant scam at the time. However, with the changing market the opportunity for that type of mortgage fraud has dwindle but we've seen an explosion in loan mod fraud, short-sale fraud and all kinds of housing schemes aimed at senior citizens including some very insidious reverse-mortgage scams. Last week I brought to your attention a new one making the rounds. Actually it's been around awhile but just making a new appearance on the scene - this is the 'Title Compliance Office' scam that warns you to have a copy of your grant deed in your hot little hands or else people can just waltz in and take your home. If you don't have it they can get you 'certified' or 'official' copy for just $167 IF you respond before 5/24. Of course anybody who has purchased a house has received a copy of their grant deed. If they can't find it, the County Clerk will happily get them a duplicate for about $10. It's been primarily seniors who have received this latest mailing so far. Today there's a new one that has also been around since at least 2004 but seems to be cropping up again out here (CA) and at least 11 other states that I'm aware of. It has become so prevalent that our Riverside County Court System has posted a warning on their jury duty site - here's how it works: You get a phone call purportedly from the court system claiming you've failed to report for jury duty and an arrest warrant is about to be issued for you. YIKES! The victim will rightly claim they never received a jury duty notice but the caller will inform them it was mailed and the presumption is that they received it and ignored it. The caller will then request some information from the victim so they can 'verify' the callers claim and 'hopefully' get the arrest warrant canceled. This information includes your social security number, date of birth and sometimes even a credit card # and/or other private information. Congratulations! Your identity has just been stolen. People tend to go along with this scam because it sounds plausible, it's entirely possible they didn't receive or overlooked a jury duty notice and they want to avoid an arrest warrant. They're a little less vigilant about giving up their information because, after all, it's the court system. In reality the court system will NEVER call you to ask for your social security number or other private info. Most courts will follow up with regular mail and will rarely, if ever, call you. It doesn't matter who is calling or why - NEVER give out your social security number or other private information to somebody you don't know over the phone. NEVER! The reasons may be different - the scam is not. The goal is to lift your identity and by the time you hang up from the call, they have already sold your identity to countless other people and you are up the proverbial creek - no paddle, no sail. Here's the official warning on the Riverside County Courts website: Be careful what information you reveal over the phone. Identity thieves have called Riverside County residents and threatened them for failing to report for jury service. The thieves then asked for confidential information. The Court and Jury Assembly Room staff will NEVER call you and ask for Social Security Numbers, credit card numbers or other sensitive information. Do not give out such information over the phone to anyone who calls you claiming to be with the judicial system. Realtors, we're part of the solution - not part of the problem. Rita thanks for the great blog and terrific points for those who may still be sitting on the fence through 2009. If you've been thinking of buying a home in the Menifee, Murrieta or Temecula, CA areas please read this and then CALL ME TODAY. How many good deals and low interest rate did you miss out? 2009 came and gone, and 2010 is here now, the extended and expanded tax credit is going to expire in April, only 3 months left for you to do something. Dear Mr. & Mrs. Home Seller, Have you ever wondered..."hmmmm....Why hasn't anyone looked at my home for sale?" Of course you do, and maybe your agent IS right and you have it priced high? Maybe you should make it less tattered looking from the street? OR maybe the agent (at your request) added a comment in the Agent Remarks section that drives other agents and their buyers away like the plague. Here are a few ACTUAL examples that I found, as I was looking through the Muliple Listing Service (MLS), of some 2009 homes that didn't sell. These comments may have kept me, other agents and buyers from looking at your home. ------------------------------------------------------------------------------------------------------------------- 1. "Seller to Find Suitable Housing Before Close of Escrow." - Or what, the deal is off and the buyer's can't move in because you haven't found something you like. My buyers are concerned with THEIR needs, not yours. 2. "Drive by only this property is tenant occupied and owners do not want tenants disturbed Please and We do not want them to know the home is for sale." - What if my buyer's want to eventually live in this house? Don't you think if my buyers were to move in OR when it goes to foreclosure the tenants might become a little disturbed. 3. "Pls don't write offers and waste our time if your buyers are not SERIOUS or if they are still writing other offers on foreclosures and holding up the property until something else gets accepted. Short-sale sellers have deadlines they have to meet. Be courteous to their situation!!!" - If my buyer's write an offer, you don't think they're serious? SERIOUSLY? Do you really thing my buyers care what your "situation" is...really? They need to buy a home, not sit around and feel sorry for you and your situation. 4. "Seller says "bring me an offer, I'll consider it". - Really? You'll consider it, how nice of you? (found in the property description comments of the listing) 5. "write contingent no showing until mid Jan, Seller may take ceiling fans and stove oven." - the buyers must wait over a month just to see the inside and on top of that you are going to take the things my buyer needs most...like the stove & oven...and you want them (and me) to wait patiently. ------------------------------------------------------------------------------------------------------------------- Ask your agent to show you a copy of the MLS sheet of your listing. READ IT AS IF YOU WERE THE BUYER OR BUYER'S AGENT. Does it make sense? Would you be discouraged about taking the time and effort to look at it? Remember it's not their fault, they are just doing what YOU have asked them to do. Sharing the Menifee Lakes Holiday Spirit - With YOU!

As a resident of Menifee Lakes, every year my wife and I drive around the neighborhood (Menifee Lakes Belcanto Tract, in particular) to look at all the decorated homes. There was a Sleigh pulled by Clydesdale horses, Christmas lighted golf carts, lighted wagon rides, fire pits, music and Christmas cheer and beautifully decorated homes where ever you looked. I would like to share with you a couple photos of one particular neighbors (garage) who wins "Best Decorated Home" every year from the Menifee Lakes Master Home Owner's Association. I must admit, well deserved! If you're in the area, be sure to stop by and see it before it goes back into storage for the year! The panoramic Christmas city photo below unfortunately only shows about a quarter of the garage and the wonderful city buildings and decorations. Complete with running trains, windmills, ice skaters, Ferris wheels, twinkling lights & stars and probably more that I missed. Enjoy! I Blindfolded My Wife and Took Advantage of Her

OK, OK, I know what you're thinking and that isn't what I mean. I am a habitual, procrastinating, last minute, Christmas eve shopper. But guessing by the number of shoppers today and of years past I know I'm not the only one. My wife and I actually met on Christmas Eve 18 years ago. I was a single dad, she a single mom, who lived in the same apartment complex when I knocked on her door to see if she would help me wrap presents for my kids that I had gone out and purchased that day. She is a life saver as I couldn't wrap a burrito if I tried. This year was no different except all the kid's have moved out and there is no longer anyone to bribe into wrapping my gifts, that is, until my wife decided she would wrap her own gifts....BLINDFOLDED! I thought this could be entertaining, so she prepared the table I went and got her gifts. What a great idea, I figured the worse that could happen is she could cut off a finger or poke out an eye, but why not? It gave her a chance to try to guess what she got, and practice on her wrapping skills while trying not to cause any permanent injuries. Oh what fun it is to watch as your wife wraps her own gifts....LOL...well as she was finishing up her last gift, I started thinking...why should this fun end...and so it didn't. Now this is where I may have "taken advantage", earned my lump of coal and have received the highest standing on Santa's naughty list..... I started grabbing items from around the house and had her wrap those as well. The hardest part was trying not to laugh as I handed her "gift", after "gift", after "gift". I could see the wheels spinning in her head too..."WOW! He did good this year!". She finally figured it out though when I grabbed an item she recognized when she picked it up..."HA, HA, HA, Nice try!" she says. I respond with a hearty..."Ha, Ha, Ha, you've actually been done wrapping presents for 30 minutes!" Let the fireworks begin! For the record - Guys..."This is mean" (So I was told) and I do NOT recommend you try this at home, results may be hazardous to your health! Merry Christmas and may you all have a prosperous 2010! Short Sales and Reasons Why They Fail!

It is apparent that real estate agents who do not take time to educate themselves on Short Sales are finding themselves missing the boat of an ever increasing opportunity and are ticking off their colleagues who HAVE taken time to learn about them. Here are only a few excuses reasons, in my opinion, that cause problems with Short Sales: 1. Inexperience and lack of training. Many agents have yet to get their feet wet in a Short Sale transaction, and when one lands in their lap, instead of learning how to do a Short Sale or get help from their broker, say nothing, cross their fingers and hope it will all work out. (Good luck!) Get training and ask questions BEFORE you take on a Listing or take on a buyer. Short Sales don't sell themselves and if you're not willing to put in the effort don't take them, give a referral to an agent you know will give your clients the attention they deserve. 2. Many agents are use to closing deals in 30 days or less. A Short Sale transaction may require an agent to wait Four (4) or more months to receive a commission check. Worried about losing a commission or having to wait for one. Get over it! I must refer you back to #1. Send out a referral, no time "wasted" on your part and someone else can deal with the stress while you are out getting other clients. When it's all over you get your referral check...WIN (you), WIN (your seller or buyer), WIN (the referral agent)! 3. Part time agents. These agents are at their "real jobs" during the normal course of the day are difficult to reach, rarely return phones calls, so any communication is done by e-mail or by leaving phone messages. Imagine how the seller or buyer feels when they've experienced the same 'lack of concern' when they can't get in touch with their agent and are just trying to get some comfort that things are actually at the bank and the agents are doing their best to get things done. 4. Finger Pointing. Rather than anticipate problems with a Short Sale, buyer's agents are quick to place blame on the LA AND the property sellers for "non-action" and "sabotage". They convince the buyers that the LA is doing nothing to follow-up with submitted offers or that the sellers must be disgruntled home owners and willing to do anything to delay their eventual "eviction" and try to convince them to cancel and move on. DON'T FINGER POINT. I see more deals go south because once the approval letter is in, the buyers and their agent has done NOTHING to ensure that things can move forward. Lenders approval will have a set time limit on how long you have to complete the transaction. If the buyer's lender & buyer's have done nothing up to this point, the pressure is back on them to jump through hoops. More unnecessary stress. I'm sure this list could go on and on, but I'll stop there! I'm sure many of you have witnessed other reasons for failure, please feel free to share!
