disputes: YOU'RE RIGHT EVEN WHEN WRONG? (spiritual theme) - 12/27/19 06:57 AM
All of the life experience remains personal and subjective. What I like you may not and if I am cold you may be warm. How then can we argue what we are sharing? In the world of personal truths all are correct unto themselves. Its when others get involved compromise and perhaps perspectives change the dynamics. Lets take customer service for an example
THE CUSTOMER ISN'T ALWAYS RIGHT BUT THEY ARE NEVER WRONG
I discovered this decades ago and it has served me well. Consider that you can find and critique anyone about anything but then ask yourself where is this going & why? In … (22 comments)

disputes: PROPERTY MANAGEMENT IS NOT PERSONAL - 10/05/19 06:12 AM
As owners of anything we tend to take what we possess and defend it as it is ours and being so comes under the realm of boundaries involving permissions and protections. Your family, car, job, personal possessions etc. need looking after some things more than others. Owning is just the beginning of responsibilities that can last a lifetime of commitment. Lets look at investments through these eyes
MY PROPERTY
Let's start with our home. Known as a place of rest, a persons castle & even sweet we come & go from it & delight in it when we do. It is so personal and … (21 comments)

disputes: IF WE DID (and did not do) WHAT CONGRESS DOES - 01/27/19 06:42 AM
When did the idea of letting your inner dysfunction become normal and supportive thus becoming acceptable take place in Congress? If there is error in a person it has to surface so that it can be gotten rid of and not repeated. Think: I once was lost but now I am found. That is the way to becoming a better more productive person.
IF CONGRESS IS THE EXAMPLE....
Here we will present a list of products, situations and services that follow the dysfunction of Congress and see if you think they have a future? I don't even like the concept let alone the circumstances but … (10 comments)

disputes: SIMPLICITY IS THE DEFAULT - 03/14/16 01:17 AM
That's how all things start out. SIMPLE. Then, once employed or engaged, its people that see how it can run this way or that and to their specific benefit or outcome. That is when it starts to get complicated. Furthermore, have you noticed that mankind cannot be governed efficiently by rules and regulations?
IMPOSSIBLE
Consider it would be impossible to have a code of conduct, a rule of use or to regulate everything to cover the needs, wants, and situations that people find themselves in. That's why we have courts of law and proceedings. They take what has happened and examine it for its intent and purpose and outcome
There are … (12 comments)

disputes: ACTIVE-GAIN or ACTIVE-SHAME? - 07/17/15 07:56 AM
I am learning about people constantly. I like to interview, ask questions and listen to what people are saying. WHY? Because I find it interesting to do and it brings me much satisfaction. O'Henry, a short story famous writer (Gift of the Magi will have you bawling), had the same bug or genes. He learned from everyone, everywhere and then wrote a short story about it
SOAP IS FOR CLEANING
There is nothing like real life drama but some things are coming awfully close. Take soap operas or the Latin channels called Novellas for instance. People would tune in and follow every detail of the players lives … (16 comments)

disputes: REAL ESTATE SPEAKS IN WRITING - 07/02/15 12:11 AM
There are forms for everything now a days and I must say that some of them are pretty good and necessary while others just waste time and drag out the process. But anyway you look at it, today's Real Estate transaction eats up quite a bit of paperwork, time and money. The effort is well spent if it produces a certain result
BEHIND THE PAPERWORK
Take a moment to realize that every form available is the result of some sort of past mishap or learning curve usually coming about from some sort of litigation that caused us to realize that if the clause, small print or initial … (4 comments)

disputes: REAL ESTATE MAKES ITS OWN RULES - 06/01/15 07:08 AM
Real Estate is not like anything else that is new to a person. Exposure, experimentation, Q & A, testing and having a general awareness helps to introduce it. With low cost items or games of fun, the risks are no big deal and you can laugh it off while walking away. In Real Estate, you are asked to get sober REAL fast before, during and even afterwards.
CONTRACT-CONTACT
Take signing a contract for instance. All those paragraphs, pages and small print mean something and have implications and dynamics that are far reaching in their affect and your ability to transact both in and out of your … (5 comments)

disputes: WHO IS BEHIND THE PAPERWORK? - 05/07/15 12:14 AM
Having a contract is a very important part of any transaction that provides services or products. The contract can be specific or general as well as limited and it exists for many reasons. For one thing, it is clarity in writing so that all parties understand the where, when, how who, and what of it all taking place
SUE!
In America, we tend to settle our differences via litigation. The courts have the last word on nearly everything we do so it is no wonder that we spend a lot of time upfront in the contractual stage. Checking boxes, initialing clauses, signing agreements all are common … (4 comments)

disputes: AGENT TO AGENT REMARKS SECTION - 01/06/15 07:02 AM
The agent remarks section on the MLS is for AGENT use to talk that "agent to agent" speak and if used correctly can narrow down certain and predictable responses. It can also help agents to free up their buyers to move on to their next potential or come forward and do business. Very important little space there and it should be respected...Now I want to contrast that with....
PROPERTY DESCRIPTION FIELD
The property description field allows one to expand on the subject property and its virtues. This is where you can write things down to market the property and what most people don't realize is that … (7 comments)

disputes: PROCURING CAUSE IS NOT COMPLEX UNLESS IT IS - 12/11/14 10:48 PM
King Solomon demonstrated it quite nicely. Who originally gave birth to this baby? Whose the real mama here? Two women claimed that they were both the procuring cause of the child. Prior to visiting with the King, I have no trouble believing that they argued, threatened and both stood their ground with each other firmly saying...this is mine!
ONLY ONE BUT WHICH ONE?
One of them was the procuring cause while the other tried to lay claim to something that while their hands touched upon the child and even had some say in its life for a brief moment and there was no denying contact... decided … (5 comments)

disputes: IS THIS YOUR SIGNATURE? - 10/30/14 12:31 AM
I have seen swirls, lines, ups and downs with curly q"s and emphasis of all kinds when watching people sign their names. I for one sometimes cannot make out the signature to the written one. A scribble where it says sign assumes that it is you the one named below. In a dispute, this can become dicey
DOES IT MATCH?
I have signed legal documents and I have had the Notary clearly point out to sign as it is presented and if you don't, then it is their testimony that is required if someone disputes that signature down the line. Why go … (12 comments)

disputes: GROW UP! - 09/28/14 12:01 AM
That was a phrase someone would use on you when their patience ran a little thin, they didn't want to speak or engage with you anymore and the time to terminate presented itself. So what did people leave you with? Short and sweet, everything they wanted to say but in a civil way..WHY DON'T YOU GROW UP!
FOR BETTER OR FOR WORSE?
You don't hear it too much anymore as being on the front lines of telling someone off. Today, people lose it to quickly, judge, get angry and upset and then start usually cursing or saying gibberish which escalates things. Not very instructive to ponder later on but instead..it … (10 comments)

disputes: PROPERTY LIENS HAVE THE FINAL WORD - 06/19/14 12:22 AM
Property owners have to be careful when contracting with others especially if a dispute takes place and it is not settled. You see the disgruntled party may just lien the property while in dispute. Even more disheartening is when you hire a contractor and he doesn't pay his help
WORKERS HAVE LIEN RIGHTS
Workers have lien rights too. If the contractor doesn't pay them, the homeowner will if they lien the property. It even gets more interesting to considering that some of those liens just stay on the property after settlement and the property owner doesn't even know that they are there until a … (0 comments)

disputes: DONT BE A DUMMY LOOK WHO'S TALKING? - 12/17/13 06:59 AM
In the world of dummies, they appear normal to each other. However if one ventured into our world, they appear to be dummies. The opposite must be true. If we ventured into their world, we would appear to be the dummy and so it went back and forth with this fellow (see pic below)
Look, I sez...why don't you make something of yourself?
He sez...I am. For now I am helping you to learn CPR
I sez...how can you help me with your eyes closed?
He says...how come you wear glasses?
I sez...because I have trouble seeing and this helps
He sez...I don't have to see … (4 comments)

disputes: IT WASNT BEAUTY THAT KILLED THE BEAST IT WAS COMMISSIONS - 12/16/13 04:45 AM
I recently sat in a hearing where there was a commission dispute. It involved no less than four agents, two principals, a bank, several buyers and finally a hearing panel. WHY? Because of the monies involved and the people who want them at all costs
HERE IS ONE REPULSIVE WORD
You see it everywhere you go but some people handle it better than others. GREED. Look at the word for just more than a second or two. It is not an attractive or inviting word but it has made itself at home in many a person on many a subject matter. GREED

disputes: MOTHER OF ALL RENTAL AGREEMENTS WAS OUR BRANDING - 12/10/13 08:38 AM
For over 20 years (1972-92), I visited the different courts across Southern California while managing properties and doing my own Unlawful Detainers, small claims actions and disputes and while waiting for my cases to be called, I heard everyone else's case.   FROM THE JUDGES MOUTH TO MY EARS   Anytime they ruled in favor for  or against a clause in a contract, I took note and changed my contracts accordingly. The result? I had the premiere rental agreement in the business for years...it was coveted by landlords, treated tenants fairly and all the courts always agreed and honored it...   REAL ESTATE: … (37 comments)

disputes: I DON'T HAVE TO GIVE YOU A REASON WHY - 08/11/13 02:04 AM
This came up from people who tried to rent properties and were rejected long ago at the start of subsidized government rental programs back in the 1980's. When renting property out back then, you have to be careful what you said as anything you say can be altered for its meaning. Furthermore, there were so many new laws involving peoples rights when doing certain things that one couldn't keep track of it all. Even if you give a legitimate reason, you may have violated that rule of law and not know it
I WILL REPORT YOU
I rejected a potential renter … (51 comments)

disputes: COUNT YOUR BLESSINGS AND OPEN YOUR HEART - 07/21/13 11:59 PM
Lately I have been walking around town a lot. I like the view one gets when walking around.  Park your car and try it. You get to see things up close and personal. There is so much going on too. I decided to have lunch and walk to the SUSHI bar where I am greeted and waited on hand and foot because I help pay their rent since I eat there often. On the way, I stopped at the family court building...woe to anyone having business there
FAMILY COURT
Family Court involves divorces and child custody suits and they get vicious … (2 comments)

disputes: SHOULD YOU BE CALLED A SPECIALIST? - 04/03/13 12:06 AM
Are you a specialist? Did you get specialized training or certification in this area of Real Estate? Having experience is not what I am getting at. I am simply pointing out that when you claim to be exceptional in a certain field, you are held accountable to it to the highest degree in that field and when challenged. Are you up to that?
I KNOW A LITTLE ABOUT A LOT or A LOT ABOUT A LITTLE
I put in over 33 years of Real Estate training. I am a professional seasoned practitioner and as such I am not allowed the luxury … (12 comments)

disputes: WHEN E & O INSURANCE GOES EEEOOOWWW - 02/20/13 11:14 PM
In the Real Estate business where the stakes are high, it is common practice to want and have E & O insurance that protects the practitioner of an event that went south whether they were at fault or not. It also protects against known or unknown circumstances and direct or indirect causes too. There is always the chance that something was over-looked and that can be costly
TELL ME WHAT HAPPENED
What if your insurance failed? What if it did not protect you? You wont know this until you call upon them and your situation is reviewed. What most people don't … (4 comments)
