Okay, so here's the scenario...
I represent some VA Buyers who are in their 2nd Short Sale transaction. The first one fell through because their Home Inspection revealed some issues the VA Appraiser would most certainly call out as 'conditions' for funding, and the Lender wasn't willing to make any pricing concessions to cover the repairs.
So now, we're under contract on another property, one which strangely had also been under contract by a previous Buyer who bailed after the inspection.

Over two years ago, I wrote a post entitled, "But I did Stay at a Holiday Inn Express!"

liability: Increasing Security, Decreasing Liability: A win-win situation - 09/30/06 08:25 AM
While the terms of real estate Listing Agreements typically contain language that absolves and protects the Listing Agent from having responsibility in the event of any loss, theft, or damage to the Seller's property, we all know the realities of liability and litigation. Everyone is always named, especially anyone with money. 
So how do we practically increase security and reduce the potential for liability when putting a home on the market? Do agents pro-actively provide their Sellers with a comprehensive list of practical suggestions for increased security measures?
