Property Fraud is a silent assault upon your real estate where the fraudster either mortgages your mortgage free property or sells it to some hapless buyer.  You don't find out about it until days, weeks, months or maybe even years later.  For a prime example, see my most read article from years back, TRUE STORY - Renter forges deed, then conspires to sell house and pocket mortgage proceeds.  Title insurance does not protect you from this type of fraud.

ALERT - ALERT - THE FLORIDA ATTORNEY GENERAL YESTERDAY OBTAINED AN INJUCTION AGAINST A FIRM TOUTING ELIMINATION OF THE MORTGAGE BY USING LAND TRUST SCHEMES.  SEE THE NEWS RELEASE AND A COPY OF THE COMPLAINT.
The issue of Quiet Title lawsuits brought by borrowers to invalidate their mortgages is gaining interest based upon flimsy default judgment success in a few isolated instances. Do brokers encourage buyers to make "no deposit contracts"?  Why are they so pervasive?  Are they legally binding?
A contract to be a mutually binding obligation on the buyer and the seller must have "consideration". 
A contract is a promise or a set of promises for the breach of which the law gives a remedy, or the performance of which the law in some way recognizes as a duty.
A consideration is something (such as an act, a forbearance, or a return promise) bargained for and received by a promisor from a promisee; which motivates a person to do something.
