palm beach foreclosure attorney: CORONA VIRUS - SUSPENSION OF FORECLOSURES - 03/18/20 12:24 PM
FANNIE MAE, FREDDIE MAC, HUD - Suspending all foreclosures and evictions as an emergency measure because of COVID-19, announced about 1 pm EDT this afternoon.
The word amongst the attorneys I have spoken to this week was that perhaps millions of mortgage borrowers - both those already years into modifications as well as new borrowers - cannot last 3 months without a sufficient paycheck. 
The action of the big 3 mortgage purchasers recognizes this inevitability and certainly a cessation of foreclosure filing on a delinquent loan will act to soften the blow.

Property Fraud is a silent assault upon your real estate where the fraudster either mortgages your mortgage free property or sells it to some hapless buyer.  You don't find out about it until days, weeks, months or maybe even years later.  For a prime example, see my most read article from years back, TRUE STORY - Renter forges deed, then conspires to sell house and pocket mortgage proceeds.  Title insurance does not protect you from this type of fraud.

palm beach foreclosure attorney: STOP PAYING YOUR MORTGAGE? – FANNIE MAE SAYS YES! - 03/03/12 09:52 PM
In a gradual and interesting development, Fannie Mae servicers have determined that short sale applicants that are not at least 60 days late WHEN THEIR SHORT SALE APPLICATION (CONTRACT) IS SUBMITTED will be rejected without review of the short sale contract.  This is quite different from previous decisions by the loan servicers, whereas the loan (if Fannie Mae is the investor – see Fannie Mae Lookup Tool for your mortgage) needed to be late by 30 days before short sale approval. [Note – the 30 day requirement was later "changed" to 60 days and sometimes even 90 days.]

In a federal bankruptcy court decision in the influential Eastern District of New York, Judge Robert Grossman explained in a 37 page decision in In re: FERREL L. AGARD, Case No. 810-77338-reg that MERS must have specific powers from its "principal" to transfer the mortgage and promissory note, and that the transfer of the mortgage by MERS does not automatically also transfer the promissory note it secures.
Borrower attorneys nationwide have called suspect the practice of the splitting of the promissory note from the mortgage using the MERS concept of "nominee" and "mortgagee of record". MER'S "... argues that any member/lender which holds … (26 comments)

palm beach foreclosure attorney: $8,000 Homebuyer Credit Extended to September 30th - 07/01/10 08:31 AM
The Senate approved the House's bill to give homebuyers an extra three months to finish qualifying for federal tax incentives that boosted home sales this spring. The House approved the measure on Tuesday. Obama is expected to sign it shortly.
The legislation extends the deadline to close on purchase contracts signed by April 30 2010, to September 30, 2010.
The bill only allows people who already have signed contracts to finish at the later date.
Congress also approved the National Flood Insurance Program, which had expired and was delaying closings for a home located in a flood zone.
