wisconsin real estate and divorce: My Client is Considering Bankruptcy ...said the Divorce Lawyer - 05/16/19 12:42 AM
We are often given a "heads up" by our referral sources that one of their divorcing clients will be calling to have us list their home along with some background on the case. They want us to contact them when we list the house . Our  contact with their client is often more frequent...and certainly less expensive for the client.
We had gotten an email mentioning a client referral and the request to let the lawyer know when/if we had been contacted.  A couple weeks later...returning to what we still refer to as the "tickle file"...we had not been contacted … (28 comments)

wisconsin real estate and divorce: Soooo....The Soon to Be Ex Spouse Disappears Before Closing - 05/03/19 02:25 AM
We often read that a real estate agent wears soooo many hats...the tour guide, the concierge, the negotiator, etc....anyone who has been in the industry for a while easily recognizes the lengthy list of multi tasking requirements an agent has during the course of a transaction.
As agents with a niche in divorce...we have to sometimes add one more hat...the ever stylish...Sherlock Holmes special.
Things can appear to be moving along with communication going smoothly with both members of the couple....and an offer accepted by both in place....and ....POOF ...one or in rare cases....BOTH...disappear...no communication with agents...attorneys...family members...neighbors, employers...the traditional methods … (56 comments)

wisconsin real estate and divorce: Getting Divorced is About "Getting Even".... - 01/31/19 04:14 AM
. Emotions run high during a divorce....getting even...getting more..because he/she deserves to get...or give....and the list goes on and on.  Some people believe that if they divorce in a community property state...every marital asset is divided equally. At this time these are the states with community property division laws:Arizona, California, Idaho, Louisiana, Nevada, New Mexico, Texas, Washington and Wisconsin. Reality is that every asset is not divided equally...each spouse doesn't get half a house...half the bank accounts.
Child support often comes into play and there are set percentages of income paid to the custodial spouse. In some cases, a parent … (17 comments)

wisconsin real estate and divorce: Real Estate and Divorce....Personalities Mix and Balance - 11/06/16 07:49 PM
As Realtors with a divorce niche....we are most appreciative when we get an email like the one received this weekend, in part it read:
"We really appreciate the time you spent with us and believe that the combination of your two personalities is a good balance for us. "
When are working with divorcing couples, a very important element is the comfort of the couple....individually AND as a couple with us.  We tell them from the beginning...that they may not always like or agree with what we tell them about the sale process...from getting … (16 comments)

wisconsin real estate and divorce: "My lender said I don't have to move, I can rent back." said the Divorcing Spouse - 08/05/15 01:10 PM
Often people hear what they want to hear....and will believe what best suits their particular situation and brings them comfort at a stressful time in their lives.
As Realtors with a niche in divorce, we understand this is a difficult time of life when tough decisions have to be made without the benefit of great emotional strength.
There are what we call the "residing spouses" that live in the marital property....without their cooperation, the sale is difficult. Showings can be denied, the house and landscaping not well kept ...their own "foil to the sale" .
From the first … (13 comments)

wisconsin real estate and divorce: "I'm Not Moving...." cried the Divorced/Divorcing Seller - 07/19/15 09:49 PM
Sometimes there are some "unique challenges" when you choose the niche of divorce in real estate.   The spouse who is living in the house can make showings difficult...leave the house in less than showing condition....not take care of the landscaping be it grass or snow.
People who have "lost control" of a part of their lives...the family they had, the income that is now shared as the court dictates, the choice to Sell due to an inability to refinance...are choices made by the court...not by them and they want to have some "say" in their future.
     That … (26 comments)

wisconsin real estate and divorce: Profit Division...A Requirement for Pre- Divorce Home Sale - 08/08/14 09:58 AM
With the housing market recovery, more of our sales for divorcing couples are right side up with equity to be divided, rather than having to endure a short sale.   It is important before you get to the closing table, to know how the proceeds from the sale are divided.  As the only Realtors in Wisconsin certified real estate divorce, we are familiar with the procedures.  To insure that both parties have a clear and legal understanding of the division of the proceeds each signs a document that is notarized which states in part:
It is agreed that the net … (15 comments)

wisconsin real estate and divorce: Divorce ....the Decision not to Cooperate.... - 12/01/13 06:54 PM
Our niche in real estate and divorce is an interesting one...and as the only Real Estate Divorce Specialists  in Wisconsin, we have lots of experience in all different kinds of situations.  When a couple has "agreed" to divorce...that is often the only thing that is common ground and everything else...the choice of a Realtor, the price of the house, division of personal property, maintenance and child support, custody and visitation...the list goes on...are all subjects for argument and debate...and legal resolution.
Often in a divorce decree or court order...the court dictates the Realtors will be chosen by....or we are … (11 comments)
