Just when I blogged about some of the banks not on board with electronic signatures for their short sales, I get a message from Bank of America stating they are going to be accepting electronic signatures on some of the documents. It is almost as if they read my blog.  Yea right! va: Is A Contract Considered Ratified if Date of Ratification is Missing? - 11/30/10 07:11 AM
A question came up at the law firm today with a buyer attempting to cancel a Virginia real estate sales contract and would of course want his Deposit back simply because he can.  Based on the missing "Ratification Date" on on the contract, did he really have a ratified contract to begin with?  Can he actually walk away because this specific date is missing?  The Seller's Broker doesn't think so, and the Buyer represented himself with the Seller's Broker preparing the contract for both parties. This of course seems to being going towards the Court Room but is there cause?

va: Short Sale Completed Through Bankruptcy - 10/08/10 12:31 PM
Even when time runs out, and still no approval yet from the third party bank on the contract at hand, and the seller gets nervous and decides to file Chapter 13 Bankruptcy the day before the auction date, you can still complete the sale of the home while in Bankruptcy.  The only difference is that there is another party involved called the Trustee.  As I have done previously, with a little extra paperwork and attorney help, you can complete the sale through the bankruptcy.  So if a seller that you are working with is in the middle of a short sale … (2 comments)
