Last Monday I wrote The Case of the Cursing Neighbor and I promised to tell "the rest of the story" after giving you time to ponder it.  If you remember, an agent had listed a home next door to an obnoxious neighbor.  This neighbor would come out in the yard, naked, cursing her neighbors whenever they were outside. 
Tricia Jumonville had an excellent question regarding this story.  She wondered if the neighbor had a mental condition and was thus protected under Fair Housing.  In reading the court case, this bit of information was not revealed so I can't answer Tricia's question but … (1 comments)

Last week, I wrote a blog entitled Dancing Ghosts and Opening Doors that discussed disclosures regarding stigmatized properties.  A comment (I do appreciate comments) that I received from Kim Kelly, an agent with Coldwell Banker Sky Ridge Realty in California, said, "If you have to ask the question on whether to disclose, then you must disclose."  It would make real estate a lot easier if that were the case but unfortunately, it is not.  I can think of many questionable situations where disclosures cannot be made or probably shouldn't be made.

I was teaching a class of prospective real estate agents a couple of years ago when I started a conversation about stigmatized properties.  Stigmatized properties are properties where events have occurred or were rumored to occur that didn't physically impact the property but might psychologically impact it.  These types of events include everything from a baby dying of infant sudden death syndrome to suicide to haunted houses. 
One of my students was very unconvinced about haunted houses.  "Ghosts don't exist," she said with her arms folded across her chest.  So I told my repertoire of haunted house stories but she still … (13 comments)
