agreement: To play well together you both must know the rules! Part 10 of 10 - 12/26/06 03:23 AM

Here is a link back to Part 9 in case you missed it!
This is the final section of the Agreement.  It covers the termination process, and has a clause designed to protect the team against "solo agents" in "Buyer Associates clothing".  Having encountered situations last year where an agent would join the team, take an incredible amount of my time and the support staff's time, only for them to depart back to a solo career armed with the training we had provided, we needed a mechanism for recovering our investment in time and effort.  Hence the grid and the time frames.  The … (61 comments)

These three sections cover advertising requirements (based on Arizona Department of Real Estate and Keller Williams International requirements), documents that the Marriott Group recognizes the Buyer Associate's personal "client tree" as being the property of the Buyer Associate and finally "standard" contract language regarding jurisdiction.
Article 8
Buyer Associates are encouraged to develop and implement marketing activities to generate prospects and add to their personal sphere of influence.  All marketing materials (electronic, printed, voice) are to be reviewed and discussed with Rainmaker Team Leaders prior to being forwarded to Broker for approval.  … (4 comments)

Here is a link back to Part 7 in case you missed it!
This section covers Service Levels (response times),  how to handle requests for assistance in areas we don't service (referrals), and what information should be obtained at first contact and entered into the database.
Article 7
Although our source(s) for leads are "exclusive", there is nothing to prevent the prospect from initiating multiple requests around the same time, and being the first agent to respond has an extremely high correlation with being the agent selected by the prospect.  Prospects that initiate contact by phone are even more vulnerable to being diverted by another … (6 comments)

Here is a link back to Part 6 in case you missed it!
This section of the Agreement is one of the most critical sections to include.  It has been reviewed by real estate attorneys (who were asked to review it by someone looking to get out of it!) and is valid and enforceable in the State of Arizona.
It essentially says, in legalese, if a Buyer Associate leaves the team, they commit that they will not take any of the team's clients, leads, etc. with them - and if they do it will cost them a 60% "referral fee" for each transaction with … (12 comments)

Here is a link back to Part 5 in case you missed it!
This section of the agreement spells out the individual expenses that the Buyer Associate is responsible for.  There has been some discussion of whether the team will provide laptops and/or cellphones to Buyer Associates in the future to enhance the security of data owned by the team - but that is still on the drawing board.
All Team Members pay for personal transactions - the amount they pay offsets the expenses incurred by the team - it's not a "profit center".
You'll note that this is one of the shortest sections in … (6 comments)

Here is a link back to Part 4 in case you missed it!
This section of the agreement describes what the Rainmaker Team Leaders provide to the Buyer Associate, and details what happens to those items should the agreement be terminated.
Article 4
Rainmaker Team Leaders agree to furnish the following items to Buyer Associate at Rainmaker Team Leaders' expense:

* E-mail Account:  http://www.godaddy.com/ 50MB e-mail account to be used for all communications with leads, prospects, clients and customers. E-mail account remains with The Marriott Group at termination of this agreement and may forward e-mail messages to departing Buyer Associate for … (13 comments)

Article 3
The following clause documents where the Buyer Associate gets initial support
Buyer Associate understands that the primary point of contact for ALL questions regarding residential real estate transactions is DAD or whoever is designated by the Rainmaker Team Leaders as the primary point of contact should DAD be unavailable.
The following clause documents that the Buyer Associate understands how we do business, and what is expected for an initial meeting with a Buyer.

Here is a link back to Part 2 in case you missed it!
Article 2 of the Agreement covers the "behavior" commitments of the Buyer Associate.  They are committing to:
Being "Full Time" - real estate is their primary occupation - and they commit to doing what it takes to take care of clients of The Marriott Group
Being responsible for their own "business continuity plan" for times they choose to be out of the office
Understanding that The Marriott Group has the ability to monitor and access all the "technology" accounts provided to the Buyer Associate in case "Murphy and his bus" show up on … (7 comments)

So now we get into the actual agreement.  The first item identifies the parties to the agreement and specifies three key points:
1.  The parties are Independent Contractors
2.  Which documents/handbooks/rules both parties agree to abide by
3.  The Buyer Associate works under the control of the DESIGNATED BROKER - not the Rainmaker Team Leader

agreement: To play well together you both must know the rules! Part 1 of a series - 12/24/06 02:47 AM
One of the questions that comes my way frequently and often is - how do you go about building a team?  One key element of any long term successful team is both the Team Leader - or in the language of Keller Williams - the Rainmaker Team Leader - and the Team Associate MUST have a clear understanding of what each party is committing to, and that understanding needs to be in writing.  It's amazing how recollections can change if there is no document to refer to!  In this, the first of a series, I'm going to share a "generic" version of … (18 comments)
