Currently, and through the end of 2012, if you sell a Phoenix property as a Phoenix Short Sale and it meets the criteria in the Mortgage Debt Relief Forgiveness Act, you won't suffer any Income Tax consequences.

In a Phoenix Short Sale there are two distinct phases of negotiations.  
The first that everyone thinks of is the negotiation with the Sellers Lender to get the approval for a Short Sale with terms and conditions acceptable to the Seller.
The second, that does not get as much attention as it should, is the negotiation between the Buyer and the Seller to get from Offer to Contract.

In our market, Short Sales are a significant and growing segment of the residential resale market.
A couple of years ago, when this was moving into the mainstream, not many agents had significant experience.

I just read an article focused on the growing trend of lenders pursuing borrowers who just "walk away" from underwater properties.

The borrowers who do their best to work with the lenders for a loan modification or a short sale in Phoenix Arizona don't appear to be on the target list for the lenders, but those who strip and ransack the property, and cause further unnecessary loss to the lenders, may well find themselves in court.
The moral of the story is - if you are down to two options - Short Sale or Foreclosure - seek legal counsel.

We're starting to see an unfortunate trend as some real estate agents are becoming "economical" with the truth.
For example: "737 Transactions closed in 2009 - I specialize in Short Sales"
One would be mis-led to believe that a large number, if not all, of the above, were closed Short Sales - when in fact, they were REOs - a very different proposition.
Another that came across the radar - but has now vanished:  "More than 2,000 completed last year - specializing in Distressed Properties - Short Sales and REOs!"

I came across a very interesting blog post - not on Active Rain - but on a sub domain of housingstorm.com.
The author, Elizabeth Weintraub, apparently shares my perspective on the distinct differences between listing and selling REOs and successfully listing and selling Short Sales.

Apparently I unintentionally offended my friend Andrew Monaghan with one of my previous blog posts:
