Britain voted to exit the European Union which ignited world economic volatility Friday. Fortunately the flight to safety buying of U.S. debt instruments resumed Friday, the losses from earlier in the week were erased, and rates improved as a result. Durable goods orders fell 2.2% versus the expected 0.6% decrease. The Treasury auctions were mixed with the 2Y weak and the 7Y strong. Most lenders allow a consumer to close in the name of their trust. The trust typically needs to be reviewed and approved by the lender. 
This should be reviewed and disucssed before a client writes an offer.
 
Some consumers prefer to provide only a portion of their trust to the lender due to privacy issues. These will usually be acceptable if the consumer’s attorney provides an opinion letter for the trust.

In a 2 to 1 decision a three judge panel ruled that Tucson’s election system was unconstitutional because it violated the 14th Amendment of the U.S. Constitution known as the Equal Protection Clause.

The City of Tucson appealed that ruling and has recently prevailed in asking for a full panel of all 11 judges of the 9th Circuit Court to review that decision.

Effective June 25, Fannie Mae will start evaluating how all loan applicants have managed their credit over the previous two years: how much they owed in revolving debt each month, the minimum payment allowed on each debt, and how much they actually paid. “Transactors”, consumers who pay off their revolving accounts monthly or pay more than the minimum payment, are a better risk than “Revolvers” who only pay the minimum payment on their revolving accounts.

The new Closing Disclosure (CD) issued by the lender for a new loan transaction is intended to be a final, accurate representation of the closing costs and the cash required from the buyer. In reality, the initial CD has proven to be a close representation of the cash needed by the buyer at closing. The initial CD is many times revised. Mortgage bond prices finished the week sharply lower which pushed rates higher. Stock strength pressured rates higher Monday morning. The U.S. trade deficit jumped 16% to $48.3B in August versus the expected $44.5B. Weekly jobless claims were 263K versus the expected 275K which was not rate friendly. The minutes of the last Fed meeting were dovish. Fed officials indicated a concern that a premature rate hike would hurt economic recovery. Unfortunately the MBS market received very little positive response from the release. Mortgage interest rates finished the week worse by about .125%.
