As time, technology and hackers move forward, so must we . . . there are any numbers of reasons why  title companies have moved to encrypted email.   In a nutshell, the below Act mandates they use encrypted email.  
 
Safeguards Rule, enacted under the Gramm-Leach-Bliley Act, requires financial institutions to implement reasonable policies and procedures to ensure the security and confidentiality of sensitive non-public customer information (NPI). In addition we must encrypt certain documents containing NPI in accordance with CFPB compliance requirements and ALTA Best Practices requirements.

  Death and taxes, two absolutes we can count on.  Spring is the season for getting your identity stolen. The U.S. Federal Trade Commission (FTC) saw a nearly 50 percent increase in identity theft complaints in 2015. Of those complaints, almost half were related to tax or wage identity theft. The IRS also reported a huge uptick in tax-related ID theft in 2015—about 2.5 times the number in 2014. All this is to say: hang tough. Identity theft is a problem that's not going away.

 Mortgage bond prices finished the week lower which put upward pressure on rates.  Rates were higher early in the week despite mixed housing data.  Existing home sales printed at 5.08M versus the expected 5.37M.  The FHFA Housing Price Index rose 6% on an annual basis.  That data showed an upward trajectory in housing prices, rising above the December data.  New home sales printed at 512K which was as expected. As an experinced buyers agent I am seeing more and more of these on properties.  Some things to keep in mind:
Leased solar units are allowable with the following conditions:
The solar unit is not included in the appraiser’s valuation of the property
The lease payment is included in the borrower’s debt ratio calculation
The lease is not a lien on the property
 
The lease contains language that the homeowner is indemnified against any damage to the property caused by the solar unit

Addendums that address repairs that are not going to be completed by closing or state a seller concession is agreed to in lieu of repairs are likely to raise red flags with the lender. If the lender sees repairs referenced on the addendum, the lender may well require that the repairs are addressed and completed even though the appraisal does not call for repairs to be done.
 
If you want to avoid additional requirements from the lender, make sure that your addendums do not list specific repairs or use the language “in lieu of repairs” but simply state the seller concession toward … (0 comments)

For consumers with excellent credit , 97% conventional financing with a 3% down payment can be a good alternative to 3.5% down FHA financing. Gift funds are allowable for the down payment. There is no upfront mortgage insurance premium like FHA and the monthly mortgage insurance will eventually drop off, unlike FHA’s that stays for the life of the loan. Qualifying debt ratios are tighter on the conventional loan compared to FHA. If the buyer is a first-time buyer, there are no income restrictions for this 97% conventional financing. As an independent contractor I can relate and understand some consumers who are self-employed experience swings in their incomes from year to year. This can cause underwriters to question the stability of their income, especially if there are large decreases in income for the consumer from year to year. This can lead to qualifying problems. There are several methods that can help these consumers. There are now conventional loan programs that only require one year tax returns instead of the normal two years. The Protecting Americans from Tax Hikes Act (the “PATH Act”) was signed into law on December 18, 2015.  Any interested parties are advised to consult a tax professional.
Included in the PATH Act is a provision modifying the Foreign Investment in Real Property Tax Act (“FIRPTA”). The modification increased the tax withholding from 10% to 15% in certain transactions. However, 10% rate of withholding still applies if: (1) the amount realized for the property is less than $1 million; and (2) the property is acquired by the transferee as a residence. The data early in the week was friendly toward lower rates. Consumer confidence printed at 92.2 versus the expected 97.3. New home sales printed at 494K vs. the expected 523K. The FHFA Housing Price Index rose 0.5%, further proof it is a good time to own a home. Weekly jobless claims were near expectations.
