10 Things Your Realtor Can't Tell You

Over the past few decades of selling real estate, people often ask questions I can't answer, either because of laws preventing disclosure, or because so many of the questions are subjective and change from person to person or situation to situation. Here are some common questions your Realtor can't tell you:Is it a safe neighborhood?This is probably the question I get asked most often. I can't possibly answer that, but I can direct you to either the local police department for crime statistics, or to online sites that can give you area crime reports. Regardless of what the current status of a neighborhood is, something could happen next week that might change your comfort levels.Is this a family-friendly neighborhood? (Or conversely - We don't want to live near children.) Familial Status is a protected class under local and federal laws, so it's not legal for a Realtor to steer a client to an area that does or doesn't have children. If you want to be in child-friendly areas, you might look at homes near schools. To qualify as a Senior Only community, there are federal guidelines that must be adhered to, and exceptions cannot be made for some families and not others.Is this a good elementary/junior high/high school? As with many areas of housing, "good" and "safe" and "clean" are all subjective, meaning everyone's opinion can be different. For questions like this, statistics can be found online for certain school criteria. Once you've identified a home that interests you, you might also want to ask neighbors, or speak with teachers and staff at the school you're considering.Can you find us a Catholic neighborhood? (or Jewish, or Mormon, or hispanic, or Lebanese, etc.) Not only is religion a protected class, but so are nationalities. A Realtor can't possibly know what your criteria might be, nor is "steering" in any way legal. If there are specific places where you would like to live, specific neighborhoods where your friends live or where your group meets or where your church is located, then we can certainly show you homes in areas you request, but please don't ask us to specify those neighborhoods for you.Are there sex offenders in the neighborhood? Megan's Law requires convicted sex offenders to register their address with local officials. This information is available to the public. You may check the public records, or, for a nominal fee, get up-to-the-minute information from the police department in the locality of where you're considering a move. Since all information is subject to change (and not everyone registers how they're supposed to), if this is an area that's important to you, make sure you're comfortable with the information you gather.We want you to advertise our house to single, young professionals. Um . . . no. Besides other things, you can't discriminate based on marital status (this is considered discriminatory against someone who is not single) and age is protected (you can't solicit to exclude the elderly).Will the house I'm buying go up in value? If we had a crystal ball, we might better be able to answer that question. In 2007 when the market was hot, people thought they couldn't lose. Then 2008 happened, and we are slowly recovering. There are too many variables - area considerations, economy (especially local), style, etc. But if you liked the house when you bought it, chances are, when it comes time to sell, someone else will like it as well, especially if it's in good and clean condition.Can we build a garage on the property? Each municipality has different laws regarding setbacks and variances. If building a garage is important to you (or a shed or a separate structure or modifying the structure that currently exists), I recommend you check with your local building department to find their specifics for what you have in mind.What's the standard real estate commission? THERE IS NO STANDARD REAL ESTATE COMMISSION. I can tell you what my company charges as standard practice, but commission is negotiable and I can't speak to what any other company or agent charges.Why do Trulia and Zillow advertise five bedroom houses for $50,000 on five acres in the mountains that were never available? I definitely can't answer that question. Thought I'd share this interesting post with all of you. TRID FAQ With the TILA-Respa Integrated Disclosure (TRID, that famous acronym for an acronym) right around the corner, I'm anxious to get started with the new way of doing business. I'm looking forward to the implementation of TRID because for one, it's a "finally, we're getting this over with" moment since the implementation has been so long in the making, and already delayed once. Also, I know TRID is going to be an opportunity to build a ton of new relationships because many lenders, title agents, attorney offices, and other important players in a purchase transaction are going to be dropping the ball in the coming months. Just last week I saw more than one person either provide false information when it comes to TRID, or openly ask "Has anyone looked into this TRID thing? Will it be a big deal?". Um....YES. It's very much a game changer. Along the way, I've run into a lot of questions, and have been through several TRID training classes. Here are some of the most common TRID-related questions I've seen come up, and their answers. Do my deals (already in process) need to close prior to 10/3 to avoid TRID? No, they do not. TRID goes into effect for loan applications received on or after 10/3. This means any loan application received or submitted (all loans in process prior to 10/3) will be playing by the old rules and still subject to the GFE/TIL/HUD-1 we've been accustomed to for the past several years. Where this can get sticky is when a borrower starts an application somewhere prior to 10/3, needs to withdraw (or has their loan declined), and needs to change lenders AFTER 10/3. Even if on the same purchase contract and the transaction is the same, the new application post-10/3 means you'll be playing by the TRID rules. Will TRID affect escrow/closing periods? This one is a great big YES. What will seem like delays as everyone begins playing by the TRID rules will quickly become the normal course of business as everyone realizes that TRID will in fact cause transactions to take at least a few days longer to get done. One thing I LOVE about TRID is that it's going to give the true professionals in the industry the chance to shine, and those who half-ass everything are going to be called on it and have a light shone on their shoddy business practices. Basically, in most cases, delays will be caused by a lender, Realtor, or title/escrow company that isn't on top of their game. A lack of attention to detail on HOA docs, not knowing the difference between a condo and townhouse, not thoroughly reviewing a contract, and plenty of other details that could be brushed over in the past can now cause some major delays. The good news, though, is that when consumers are working with professionals on top of their game, delays should be rare, and minimal. In the real estate industry, there are always bound to be surprises that come up along the way, but thankfully, only these one-in-a-million type surprises should cause delays. Most other delays can be avoided by doing the job right from the start. Will TRID make things more confusing? Yes and no. The time lines, disclosure rules, delivery options, disclosure receipt acknowledgements, and other things will certainly take some getting used to. On the other end of the spectrum though, the new Loan Estimate (LE) and Closing Disclosure (CD) will make things far less confusing for consumers. This is another area where TRID gets it right - the disclosures leave very little room for confusion compared to the current monster we have in the GFE-TIL combination. How can we avoid delays? I brushed on this above, but there are 2 areas that will make or break a closing time line under TRID - one is on the consumers. It is IMPERATIVE that buyers and borrowers are communicating with their lender and returning all requested documents immediately. Under the current system, we have a small window where it's not a huge deal if borrowers aren't extremely responsive (or in less kind terms, slacking). Under TRID, that window is all but gone. If you're getting a loan as a consumer, you'd better be ready to get your lender what they need, when they need it. The other area where delays can be avoided is going to be on the lender, the Realtor, and on title/escrow. Things that used to be done "along the way" or "closer to settlement" are going to be need to be done up front (the way they should be). HOA docs, condo information, all costs and fees (even potential ones) need to be known up front. Things like capital contributions, inspection costs, potential re-inspection fees - all of these things are going to need to be addressed up front. Can We Still Close in 30 Days or Less? In short, yes. In reality, it's going to be a smart move to start moving contract periods out to 45 days as the standard. 30 days is doable, but things will need to go perfectly, and any small hold up along the way is going to push things past that 30 day period. In the case of a rush or an absolute necessity to get things done faster, we can turn on the afterburners and things can get done in 30 days, but you'll be doing yourself, your clients, and your business partners all a favor by giving a week or 2 longer on purchase agreements from contract execution to closing. Once TRID is understood and processes are gradually made more efficient, the process should be smooth sailing. I'm glad to be at a company that is ahead of the curve with extensive training and man hours going toward making sure we're ready for 10/3. For those not ready, or those who don't completely understand the rules or have a process in place to handle the changes, I feel sorry for them - there are going to be a lot of damaged relationships, angry buyers and sellers, and professionals left looking less than professional. What Can You Do To Protect Your Credit Score? Your CREDIT is a big part of your financial health. It is identified by your CREDIT SCORE. Your credit score indicates how you use money over time. How much of a risk it is to loan you money? Are you responsible or irresponsible with money? If your credit is good it can help you to borrow money at a lower interest rate for long and short term loans. If not it can hurt your future ability to borrow money. So you have to maintain a good credit score before you want to make a big purchase like a home or a car. A low credit score can also negatively affect you in other areas of life. When renting a home or an apartment; landlords or property management companies routinely check the credit score to see if the prospect is a responsible tenant and is willing and able to pay the rent on time. What can you do to protect your credit score? 1) Your Payment History How good are you about making payments on all your current bills and balances? Always consistently pay your bills on time as accounts in collection are a big negative for credit score. If you cannot pay your credit card balance in full, be sure to make the minimum payment on time. Late and missed payments cost more in the long run, as you can be charged a higher interest rate for credit, later on. Setting up automatic payments for fixed expenses is an easy way to avoid missed or late payments. 2) Balance You Owe How much credit do you have available? One of the factors that determines your credit score is the amount of credit you have available. The debt to credit ratio should be as low as possible so it is a good idea to keep the overall debt lower than the total credit available. Try to reduce your balances by paying a little more each time than just the minimum payment. Be careful about closing unused credit card accounts. This can also be viewed negatively in determining your credit score as the less credit you have available the lower the credit score. 3) Your Credit History How long have you been borrowing and managing money? The account age is also important. It is not a good idea to close old credit card accounts which show you have been making payments on time as those accounts are a part of your credit history. 4) Newly Opened Accounts What have you been up to lately? Be careful about opening up a bunch of credit cards in a short period of time. The credit reporting agencies view you as a high risk when you apply for too much credit in a short period of time. Think about that every time a department clerk asks if you want to apply for a department store credit card. 5) Annualcreditreport.com Have you checked your credit report recently? Check your credit report at Annualcreditreport.com. At this site, once every year you can get a free credit report from each of the three credit bureaus, Experian, Transunion and Equifax. Check the report for accuracy and also make sure you are aware of all existing open accounts. Don’t risk your financial health. Having a good credit score should be an ongoing priority. Convenience to Work: Living in a home which is a convenient commute to work is a priority for home buyers. Will Home Mortgages Become More Expensive, Soon? Did you know new lending guidelines will be in place beginning this March? Home prices have been on the rise and along with that the mortgage interest rates too, have gone up. Lending rules are getting tougher. Even though Fannie Mae and Freddie Mac do not originate new mortgages they do buy about 66% of the loans underwritten by the banks. Fannie Mae and Freddie Mac have announced new tougher guidelines which go in effect starting March 2014. This is expected to easily add about half a point to the interest rate that a fixed rate borrower will pay. Next month in February 2014 federal rules known as “ability to re-pay” and “qualified mortgage” are also set to kick in. These rules impose tough penalties for banks that write unconventional mortgages that go into default later on. With the fear of penalties, banks will not have much leeway when considering loans to borrowers who are self-employed, who are commissioned or have a new job. The governments’ bond buying program called Quantitative easing has helped keep the interest rates low till now. However the Fed is winding down on quantitative easing, what this means is that we should expect to see a rise in the mortgage interest rates. What should those buyers do, those who are considering buying and will also need financing? Buyers who are on the fence about buying should not wait much longer because higher interest rates erode buying power. If for example a buyer is qualified for $200,000 home mortgage at 4.75% for a term of 30 yrs. The monthly installment will be $1043.29. If the interest rate goes up to 5.5%, to keep the monthly installment at $1043.29 the mortgage amount has to be $183,746. So the buyer gets a smaller home for the same installment or the monthly installment has to go up approximately $92.29 up to $1135.58 for a mortgage amount of $200,000 and a loan term of 30yrs. How Many Lagoons Make Up The Indian River Lagoon? Did you know that the Indian River lagoon on The Atlantic coast of Florida is really a group of three lagoons? Yes that’s true. Together the Mosquito Lagoon, Banana River and Indian River make up the Indian River Lagoon. The Indian River Lagoon or estuary is separated from the Atlantic coast by the barrier islands. The Indian River Lagoon is 156 miles long, it extends from Ponce De Leon Inlet in Volusia County, to the southern border of Martin county. The Indian River Lagoon is connected to the ocean by a few ocean inlets and this allows the saltwater to mix with the fresh water which comes from runoff from the surrounding land as well as from the rainfall. Any changes in the amount of freshwater, or pollutants or sudden changes in temperatures affects the marine life and vegetation of the lagoon. The Lagoon is home to over 2000 species of marine life and over 2000 species of vegetation. The inlets are really picturesque. One such beautiful view is on A1A near Sebastian Inlet. As you drive on A1A over the Sebastian National Park, you see the ocean waves on one side of A1A and the quiet waters of the lagoon on the other side of A1A. It is quite a sight! Here in Brevard County, Florida the view on the lagoon is never the same! You may see a dolphin jumping out of the water one minute and ducks swimming by another and then maybe a pelican diving in to catch a fish. Next maybe a water skier behind a boat and next a sail boat perhaps. In the spring time it is exciting to see schools of newborn fish swimming in a zigzag fashion on the lagoon floor. I have had the opportunity to see more than one sting ray on the lagoon floor. Some areas of the lagoon have been identified as Manatee zones and boats have to run on idle speed in these areas to protect the manatees. The Indian River Lagoon is also known to have a diverse variety of bird population as its inhabitants. Many of the waterfront homes in Merritt Island, Satellite Beach, Indian Harbour Beach, Indialantic and Melbourne Beach are on the Indian River or the Banana River. Many of the homes on exclusive Lansing Island are on the Banana River and the lovely and exclusive Tortoise Island subdivision has homes on both the Banana River and Indian River. Why Living in Harbor East of Melbourne Beach is So…ooo Special! Melbourne Beach is an Oceanside town of about 3300 residents. Ocean Ave is about less than a mile and ends into the Indian river at one end and the Atlantic Ocean on the other. Melbourne Beach Pier is a great place for fishing and just relaxing. Nearby is the Ryckman Park perfect for a family picnic or a game of tennis on the adjacent tennis courts. In the summer months Melbourne Beach hosts movie nights in the park for its residents. Town Hall, Police and Fire Departments as well as the post office are also on Ocean Ave. A short walk down the road towards the Ocean, and you are near the library and a community supermarket and bank. Melbourne Beach Library hosts many events for children and adults. The Ocean Park by the beach is great with volleyball court and picnic benches and access to the beach. The first Saturday in May is Melbourne Beach Founder’s day. There are festivities held all day at the Ryckman park, starting with a 5k run in the morning and ending with music in the evening at the park. Should you sell your home now or should you wait? Here are some reasons why this is the perfect time to sell your home: There is a Higher Demand for Homes on the Market One of the most basic concept of economics is supply and demand. According to the Florida Association of Realtors closed sales of single family homes in Brevard County, FL for August 2013, are up by 11.5% since August 2012. The report also shows that there is only a 4.1 month inventory currently available in the market. In a normal market there is about a 6 month supply of homes. So we can see that available inventory is somewhat low. There are buyers out there who are seriously looking to purchase a home. Sellers of homes sold recently have seen multiple offers on their home. Currently competitively priced homes are selling at or close to their asking price. Higher Interest Rates Erode Buying Power Interest rates have remained at historic low levels for a long time now but for how long will they remain so? Most experts agree that they will rise within the next twelve months to eighteen months. Sellers should take into consideration that this will reduce the number of buyers who will remain eligible to purchase their home. As interest rates rise, the buying power of buyers will be reduced. A buyer who can afford a 200k home today will be able to afford a home for less than that amount. Also remember all the homeowners whose equity had eroded and they were under water the past few years? Many of them have regained lost equity as home prices have risen.
