Advertising is considered to be a real estate service. Licensees must advertise in such a way so that the public is not deceived or misled. False or misleading advertising is illegal.
 
Anyone in a real estate office can advertise. However, all advertisement must be under the direct control and supervision of the broker because advertising is considered to be a broker activity. Advertisements must be submitted to and approved by the broker of record. No matter who advertises from the real estate office, the broker is ultimately responsible. False advertising is a second-degree misdemeanor. 
Anyone who advertises or represents that they are providing real estate services is acting as a real estate broker.  Therefore, advertising is considered under Florida law to be a broker activity.

The rules regarding advertising real property do not prevent real estate licensees from selling their own property.Real estate licensees who are selling "by owner" may place their own classified advertisements with their own personal contact information. It is not necessary for a licensee to indicate in the advertisement that the seller is a real estate agent            - But to reduce liability the licensee-seller should disclose at the first point of meaningful contact that they are licensed and disclose it on the contract.
