An unenforceable contract is a contract that cannot be proved or will not be recognized by a court. A contract may be unenforceable because it is not in writing, the statute of limitations has passed or because the property is destroyed.

Nearly every business transaction is based on a contract.  The key to every contract is the promise. In real estate contract, the seller promises to convey title and the buyer promises to pay. Contract promises are enforceable by law.
To draft a legal document for others is considered practicing law. Real estate brokers and sales associates may not prepare deeds, mortgages, promissory notes or other legal documents. Licensees who prepare such instruments could loose their license, regardless of whether they receive compensation.

A radon gas disclosure statement on real estate sale and lease contracts is required on at lease one document before or at the time of executing a sale contract or rental agreement for any building.  Such notification shall contain the following language:

All newly licensed sales associate and broker licensees must take required post-license education before the end of the first license renewal period. Rule 61J1-4.009 F.A.C. states that failing to complete the required post-licensing education hours prior to the end of the second renewal cycle will result in the license becoming Null & Void.  It cannot be renewed after that time.  You will have to submit a new application and receive a new license to continue appraising.

•Continuing Education course providers electronically report the completion of a licensee course within 10 business days beginning on the 30th day before the renewal deadline or prior to the renewal date, whichever occurs sooner.
-Complete your continuing education early to ensure your credits have time to post in the state system.  Before the renewal date, check the CE credits on myfloridalicense.com and notify your education provider if credit has not been posted.

•The applicant must send a Form-2050 signed by the employer to the DBPR by mail or fax to change the license status to active before going to work.
 •New licenses may not begin working until the DBPR Web site shows that the license is in active status under the brokerage entity.
The state Exam is Tough.   About 41 to 44 percent pass the first time.  For applicants who take the exam more than once, the passing rate is decreased to 26 to 30 percent.

Applicants must be at least 18 years old, have a high school diploma or equivalent, complete a 63-hr.
education course, have good character, and pass the state exam. The exam has 100 multiple choice questions. 75% correct is passing. Applicants should not underestimate the difficulty of the state exam.
The tuition includes all books and materials. Advance registration is preferred. Because of the lead time for applying for the state exam, you should call to enroll right away! We'll send you your books and application up till a week before the class starts. You may use your VISA or MasterCard.

The commission shall license a broker associate or sales associate as an individual or, upon the licensee providing the commission with authorization from the Department of State, as a professional corporation, limited liability company, or professional limited liability company.
