Conflicting demands occur when the buyer and seller make demands regarding the disbursing of escrowed property that are inconsistent and cannot be resolved. There are two types of consideration: 1. Valuable consideration is the money or a promise of something that can be measured in terms of money.2. Good consideration is a promise that cannot be measured in terms of money,such as love and affection.
Either type of consideration is sufficient to enforce a contract. The law generally does not concern itself with the relative fairness of consideration. What is exchanged need not have the same measurable value. The law will determine that the parties thought the consideration to be fair because they freely agreed to the exchange.

Mutual assent refers to the making and acceptance of an offer. The parties must come to a meeting of the minds, meaning they must reach an agreement on all terms in the contract. One party (the offeror) makes an offer, and the other party (the offeree) accepts that offer. A complete and mutual understanding must exist to produce a meeting of the minds.
The contract is formed at the instant that acceptance of the offer is communicated to the offeror. Therefore, a contract is formed on the acceptance of an offer and communication of the acceptance.

A licensed personal assistant must be registered under the employing broker and may be paid for brokerage activities only by the broker. A sales associate may pay the licensed personal  assistant  for non-selling activities on a salaried or hourly basis, but may not compensate a personal assistant for performance of brokerage activities that require a license.

For a licensee's personal name to appear in a brokerage firm's Ad, the licensee's last name must be included at least once in the Ad to avoid charges of "blind”.. advertising.
For example,
Joseph J. Perkins, a sales associate, could place an advertisement stating "Call Joe for more information," provided the Ad includes the brokerage firm's name and Joe's last name, at least once, somewhere in the Ad.

licensees can prospect for expired listings by: direct mail,  telephone, or visit.
 Direct mail may be too late because owners who want to sell often list with another ii broker immediately after the listing expires.
 A visit may not be as time-effective as first telephoning, but visiting the owner is more likely to result in getting the listing. When they answer the door, remember that your objective is to be invited inside to view the home and getting an opportunity for a listing presentation.
