I need advice on selling display home that builder does not own

I have been working with a builder who has lost most of one subdivision back to the banks.  He has sold 2 display homes to investors and are now leasing them back.  He has an amendment to the lease giving him authorization to list and sell the homes, and wants to enter into a listing agreement with me.  I feel that the listing agreement (and future offers) need to be signed by the actual owner, but he is pressuring me to get them listed because of the amendment.  I know each state is a little different but has any one run across this before?  I've asked our Board Attorney for legal advice but just wanted to see if anyone else has had this happen yet.
