Recently, a reader had a question about an offer she is making which concerned the difference between an offer and a real estate contract. She asked:

When we looked at the house we put an offer on, the seller’s disclosure indicated that, among other things, the washer and dryer conveyed with the sale. We are still negotiating, but the washer and dryer have been removed from the premises. Our agent says that is perfectly acceptable, but I don’t understand how they could be put in the disclosure as included and then they aren’t. Is this really allowed?

So, the real question is when you negotiate a home purchase, what is included in the sale?

Negotiating buyers and sellers can get crazy sometimes when it comes to items that get removed prior to closing.

Agents usually ask their sellers to FULLY COMPLETE the "Seller's Disclosure" which probably include the questions as to whether the washer and dryer are in operating condition, even if it hasn't been determined that these appliances will be included in the sale.  The reason is that they MAY be included in a Buyers offer and eventually become part of a deal.

Thanks Lizette and I agree. But if it is post contract, the seller is defaulting on the contract (if the items are included in the contract or through reference to the sellers disclosure(.

Thanks Tom, and I agree that is where the confusion begins. There is a different between "MAY" and "DOES."
