Broker Fees?

I’ve seen an annoying new trend.  Buyer and Seller “Broker Fees”.  It may go by various names, but amounts to the same thing…  what Clark Howard would call a Junk Fee.

These are quite different from the other fees that may be involved in a real estate transaction, and there are a LOT of fees.  The lenders have fees, the closing attorney has fees, there are state fees, county fees, insurance fees, delivery fees…  Simply put, buyers and sellers are paying plenty of fees.  Adding some BS junk fee like a paperwork fee, transaction fee, administrative fee or broker fee is just adding insult to injury.

There is already a commission or sales fee that the real estate broker and agent are sharing.  There is no reason to add another official sounding fee on top of this that is after the negotiated amounts.

And, that is how it usually works… the seller negotiates the fee for selling their home, and everyone shakes hands… and then the agent mentions that there is a $495 paperwork fee or something along those lines.  They say it is required… maybe not saying that they are the ones requiring it…

In the case of buyers, after going through the buyer’s agency agreement and telling the buyer that the commission is generally paid by the seller, they hit the buyer up for a transaction fee… again, saying it is a requirement.

There are various reasons for this…  What it mostly comes down to is that people and companies in the real estate industry are hurting for income.  But, many of our clients aren’t exactly rolling in money… and even if they were, it isn’t right to tack on junk just because we think we can… Some agents are working for companies that charge US a closing fee for closing a transaction instead of charging a split and the agents are passing it along.  It should be part of their cost of doing business.

I just say NO!

No additional fees.  You will know EXACTLY what you are paying for my services prior to delivery and prior to completing the negotiations.  I try to deliver more for EVERY client than other agents… but that doesn’t mean I need to add junk fees on top of fair fee structure.

Me too, Lane.

My broker charges us a fee, but I will not pass that on to my clients, just won't do it. The other agents in my office don't get my stand, but I've got to do what I think is right. Treat my clients the way I'd want to be treated, and I'd not appreciate any added fees.

I started a few years ago and seems to have caught on in our area. A number of the brokers have added them to try to increase profitability.

I'm not for adding fees, but I AM for having a retainer fee. And if you buy, or your property sells, it will then be taken out of the commission. I think this would keep every one "honest"....to a point.

Buyer realizes we have expenses in touring them around, doing research, negotiating contracts, paperwork, etc. Then, the deal falls apart for any number of reasons. But we don't get paid a penny. This way there would be some recovery of our time and efforts. Again, if they buy and close, it's taken out of the commission.

Same would apply to Sellers. We spend all the time and money to market the property. If if does not sell, or better yet, the Seller decides to take it off the market, where does that leave us. We don't get paid a penny. Yet we had lots of expenses.

I think it would be a win-win for everyone.

Thom - I understand the retainer and I am thinking of a plan to make that happen, too...  If people want to pay it...  Of course that means I want to find a way to incentivize it.

Here's a junk fee that's equally ridiculous--and tawdry. Listing Agents in my area of Florida are allowed to charge what they call an "MLS Fee," which  is a reduction of the selling agent's commission by an arbitrary fee that I've seen rrun as much as $500. This is accomplished, with the complicity of the local MLS, by stating the compensation to the selling agent as a percentage and then adding a flat fee commission reduction.

For example: 3% - $250. So on a $100,000 sale, the 3% commission would be $3,000. Bu the Listing Agent deducts $250, so the commission is actually $2,750. 

My MLS specifically does not allow anything to be called an "MLS FEE," since the MLS does not charge a fee. So, most Listing agents call them transaction fees, and defend them by telling Selling Agents to pass the fee along to Buyers. I don't and won't. That fee is simply the Listing Agent arbitrarily reaching into my pocket for a fee that pretty much equates to the "delivery fee" used car dealers charge for a car sitting on their lot. It's a junk fee and nothing more.

I think it's critical that ALL junk fees be eliminated and that the real estate transaction process be demystified as much as possible. And realtors need to stop picking clients' AND each others' pockets in pursuit of every last dollar.

I am very curious about the how "MLS" fees" or "commission reduction" fees play into Selling Agent compensation in other areas, and would welcome any comments or insight as I pursue the issue.
