Patent and latent defects - flooded basement

Just ran across a case where the buyer did not take the agents advice for a Home Inspection. It looks like the court used common sense in this case.

It also looks like the "as is" phrasing was discussed in this case.

Glad to see that the agent did (his) job.

Back in my younger days, long before I got into real estate, I bought a house directly from a bank. Two weeks later on Valentine's Day the toilets overflowed due to weeping willow roots. The yard had to be dug up and the pipes replaced. In the spring, the basement filled with water after a hard rain. When we decided to get a new furnace, we discovered the stuff wrapping the ductwork was asbestos. One problem after another... one repair after another. Never again... Inspections! Inspections! Inspections!!!!!!

Some people will never never learn. I stress it even if the house is brand new. We live in a CYA world.
