The Healthy Homes Survey, Oct 7, 2008 revealed the following statistics for older homes...

  • 86% of homes built before 1940 contain lead based paint.
  • 66% of homes built 1940 to 1959 contain lead based paint.
  • 25% of homes built 1960 to 1977 contain lead based paint.

Active real estate practitioners should be familiar with the issue of Lead Based Paint, as we've been required to address it for a number of years and now the remodeling industry is being required to acknowledge the perceived health threat and respond by complying with the following EPA Renovation, Repair and Painting (RRP) guidelines posted on their website...

Information for Property Owners of Rental Housing, Child-Occupied Facilities

Property owners who renovate, repair, or prepare surfaces for painting in pre-1978 rental housing or space rented by child-care facilities must, before beginning work, provide tenants with a copy of EPA's lead hazard information pamphlet Renovate Right: Important Lead Hazard Information for Families, Child Care Providers, and Schools

After April 22, 2010, property owners who perform Renovation, Repair and Painting projects in pre-1978 rental housing or space rented by child-care facilities must be certified and follow the lead-safe work practices required by EPA's Renovation, Repair and Remodeling rule.

Contractors who perform renovation, repairs, and painting jobs in pre-1978 housing and child-occupied facilities must, before beginning work, provide owners, tenants, and child-care facilities with a copy of EPA's lead hazard information pamphlet.

After April 22, 2010, federal law will require contractors to be certified and to use lead-safe work practices. To become certified, renovation contractors must submit an application and fee payment to EPA.

Although the greatest risk is in an owner/tennent hiring an attorney and pursuing legal action for damages to the health of their family members, contractors who fail to comply with EPA practices could cost face up to "$32,500 per violation, per day" in fines, according to the agency's Small Entitiy Compliance Guide.
