What's Up with That!?

This is proving to be a very hectic week for me.  As much as I enjoy being busy, it is pushing my limits!  But that's not the point of my blog.....not sure I have one, but wanted to share an experience.

Recently Fannie Mae updated the appraisal reports that appraisers use.  On it, it asks if the appraiser reviewed the sales contract on a purchase. 

I went on an assignment this week and when I asked for a copy of the sales contract for review, the realtor asked "why" I needed. it.  After explaining that Fannie Mae required that I review the contract as well as the lender, and that I have to verify if there were any terms of sale or concessions, or anything that pertained to the sale, she stated, "well, we all know what we're suppose to do, but this is just to important of a sale to show you the details of the contract."  I was a bit taken back!  I politely stated that I would be calling the lender to let them know what she had said and that she would be holding up the appraisal process.  She gave me 'firm' look and stated she would fax me copy within the hour.  I got the copy.  Not sure if it was the original or not, but its in my work file none the less! 

The contract didn't have anything substantial, or anything that I would consider "unusual", however, she was shameless none the less.  My issue about this isn't "can't we all just get along?"  Its about knowing what you are suppose to do, what the law is, what is right and ethical and doing it regardless of what is at stake and not trying to slide by or get around the law.  

There are times when I go on assignment and the realtors have everything I need before I even ask, and go beyond the call of duty to being helpful, so I'm not upset by the one!  Just taken back a bit!

I'm not sure how the realtor doesn't understand why - due to all the fraud out there, especially with the (past) availability of 100% financing for investors - Fannie Mae has become much stricter with their guidelines.  

Oh well, try not to let it bother you...and congratulations for sticking to your guns, as apprasials are getting more and more scrutanized by lenders.

Jeremy - WHAT'S UP WITH THAT  is right!!  I don't get it either and I think it's a waste of time to try to understand it.  We will have those people in our industry who are polite and helpful and then the rest.  Hope your week gets better.....tomorrow is FRIDAY THE 13!

Don't let it bother you, but keep in mind the average agent is doing 3.5 transactions a year. That kind of volume doesn't give them enough experience to keep on top of the changes, and you did say it was a recent change. You might print copies of the bulletin that requires this review, just to take the heat off of you. Also explain it when you make the appraisal appointment. If that fails, doing what you did is the right thing.

Jeremy,

As always there are better ways to handle situations on everyones part. Maybe explaining to the REALTOR that FM recently "changed" their requirements and you are requesting a copy of the contract  and as for the REALTOR she shouldn't have jumped the gun to assume that her contract was not safe in your hands. Further she should have "politely" questioned why you needed it.

My point is that it all comes down to communication. We can all get along as long we communicate effectively. Sometimes it's not what was said but "how" it was said.

In So. NH. the lender simply provides the contract to the appraiser -- that takes care of the entire matter.  Can you go to the lender rather than the realtor?
