I am buying a house that is listed as Duplex with the County, however it is a single family home. The city is telling me that the home can not be used as a duplex and they do not allow it under their control. The city was created after the house was built, so there is some difficulty with changing the records. My difficulty is that the underwriter is saying that it needs to be financed as a duplex (the loan program asks for a larger down payment on 2-4 units) because what is on the County records.
Can the city over ride the county? How is this changed quickly on the records for the underwriter?
