Afraid I have to STONGLY disagree with you on this one, at least here in the Washington DC area.....in MANY MANY cases it is in the owner's best interest to strategically default.....I am certain we could go back and forth for pages and pages, but, each client is different, and, each situation is different.  Having done this across the country for more than 4 years full time, there are clear instances when it is in the owner's best interest to default.....the surest way being that it will end the process more quickly so the owner's can move on with their lives.....many agents get caught up in getting paid adn NOT doing what is in teh owner's best interest.  Having an inexperienced agent work a short sale and have it drag on for 6 or 12 months is HORRIBLE and cna be catastrophic for any homeowner looking to get past their property challenge (it can cost them their health, their marriage, etc.).

Ben, This is intended to call homeowner's to action to show them they do have options. Your right a short sale might not always be the best solution for a homeowner. Each homeowner's financial situation is just as unique as a person's fingerprint, we make sure that we do a thorough forensic analysis of their situation before we proceed forward. We encourage homeowners exhaust all avenues trying for a loan modification first. If a short sale is the next route that is necessary for the homeowner then we proceed. It is critical for California Realtors to have a working knowledge of California Anti Deficiency Laws. Realtors must be able to advise their clients appropriately and ensure their clients seek legal advice because in some cases it is better to go through a foreclosure to get the protection of the Ca Anti Deficiency Laws. It is up to the homeowner to decide whether they will accept their lenders right to pursue deficiency language commonly seen in short sale approval letters.

This real estate market has caused unbearable stress and heartache. My husband Gary and I are a team as a Pre Foreclosure Specialist Certified, PSC with a Certified Distressed Property Expert designation, CDPE we have the training and expertise necessary to minimize homeowners financial loss and limit the damage to their credit. We negotiate all of our own short sales, we do not use a third party to negotiate our transactions. We feel that education is key in this market with so much misinformation and foreclosure scams out there, we sought out this education to ensure we could properly help families get on the path to recovery.
