New EPA mandated changes

I represent many investors who complete their own work on flips or rental investments. An important new EPA law goes into effect on April 25, 2010. This law requires that for any work, disturbing more than 20 square feet, be completed by a certified worker.

To quote from the EPA website: "contractors performing renovation, repair and painting projects that disturb lead-based paint in homes, child care facilities, and schools built before 1978 must be certified and must follow specific work practices to prevent lead contamination."

All contractors should follow these three simple procedures:

  • Contain the work area.
  • Minimize dust.
  • Clean up thoroughly.

To become certified will require some training and completing an application for certification. It is my understanding that it costs about $500 - $700 to become certified.

Dave,

On the one hand it is a complete pain in the backside. The actual certification is the smallest part of the hassle. From my understanding, all the work needs to be documented. If someone actually gets lead poisoning, then the real fun begins. If your documentation is not in order or you have not used a certified contractor, there may be severe fines levied.

On the other hand, protecting children from getting lead poisoning is a good thing. As usual, the people who do not do work in the right way, create headaches for the majority of people.

This the first I've heard of this ! I wonder how the EPA intends to get the word out to small business owners ????????

I learned about this from my contractor friends. They were notified through their contractor networks, however, beyong that most others are unaware of this fact. I think the only way it may be enforced will be if a person gets lead poisoning. Otherwise it will be very difficult to enforce this law.
