BofA Short Sale Success...Sometimes, The Squeaky Wheel DOES Get The Grease!

Many of you read the blog I wrote last week titled, "Is BofA Servicing Your FNMA Short Sale? If So, You Need To Read This....".  

Basically, BofA was servicing a FNMA-owned loan.  FNMA had given their approval for the short sale, but BofA decided to foreclose on the home less than two weeks later, despite telling us that the foreclosure had been postponed.  I immediately contacted our local NBC affiliate, and they ran a story on it last week.  Visit our media room to see the video.

To make a long story short, today I received an email from BofA, RESCINDING THE FORECLOSURE that took place on March 17th, 2010.  You heard it right, FNMA is deeding the home back to my clients so that they can proceed with the previously-approved short sale!

So, my clients, who tried to do the "right thing" and not simply walk away from their home, will not have a foreclosure on their credit report.  Needless to say, they are thrilled with the news.

The next time a lender makes such an egregious error, CALL THEM OUT BY CONTACTING THE PRESS.  Lenders like BofA do not like these stories getting out to the public, as evidenced in this case.

Moral of the story:  Short sales are a contact sport.  Don't be afraid to take off the gloves and start swinging.

Thanks for the kind words.  Simply put, we got lucky and found a reporter who was willing to expose BofA for their egregious behavior.  I just wish the mainstream media would pick up this stuff and report it like they should!

It's sad that the only way to get the attention of these lenders is through the press, but it is the world we now live in.

Wow Good Job! Hopefully the short sale process will become an easier process as the lenders learn from their errors. Or am I just optimistic?

Ummm...My Grandfather always told me to NOT count my chickens before they hatched. Even if you end up working with BOA, plan on a transaction filled with confusing, misleading and unprofessional behavior. Oh and at the end they will cut your commission after agreeing to something different somewhere along the line...

Robert, you are the best.  I've have one go to foreclosure after sending the short sale 4 different times.    I'm sure they received it, but would never acknowledge.

Someone recently called the press on a short sale problem with a bank. Believe it was B of A and after the press go involved the problem got solved. Funny how that works.  :-)

We did it once, and did not go to the media. there is a wall between the Loss Mitigation dept, and the law firm chosen to handle foreclosures. It is not unusual when somethere things go wrong. All we needed to do is to forward the communication where the Lender agreed to delaying the sale, and they rescinded the sale and we later closed.

Hi Jon,

It's extremely rare when we contact the media as well.  However, in this case, BofA refused to delay the sale (this is a follow-up to a blog I had written earlier).  Obviously, had BofA agreed to delay the foreclosure, we would have closed the short sale as planned.  In this case, however, BofA foreclosed anyway, and had to rescind the foreclosure (i.e. give the house back to my clients).  It's all in the original blog that is referenced in first sentence of this blog.
