The Wall Street Journal reported that a Federal District judge in New Orleans earlier this month ruled against Taishan Gypsum Co. Ltd. in the amount of $2.6 million in a suit filed by 7 Virginia families. There are several dozen pending cases centered around the so called "Chinese Drywall."
One of the issues in this suit and probably affecting the others is the TGC, Ltd. is owned by the Chinese government and it is not clear if they can be compelled to pay. No one representing the government has acknowledged this lawsuit or attended the proceedings.
Will Taishan pay? Everyone involved in the other suits will be waiting to see.
One of the problems here in the Tallahassee area has been lack of inspectors knowing how to check for this product. To my knowledge we have yet to have a report of this product being used in our area, but it is quite difficult to know quite frankly.
This is issue is most often being treated much like the existing polybutylene piping in the area. If it is working and has not failed (or gives off a bad odor) then it is probably okay.
This is clearly an issue that has yet to be completely clarified or resolved. Stay tuned.
