Would you ever turn a fellow Realtor away from you listing?

I had a shocking conversation with a Realtor here in my area a couple days ago.  She didn't want me to sell her listing!!!  I could not believe my ears!!

I have a piece of commercial property listed and I receive a lot of calls on this listing.  This particular caller was from out of the area and is very interested in properties of this sort, but didn't thing my listing would be for him.

Like any other caller, I took his information and told him that I knew of a few other similar properties and would be happy to put together a packet with information about the others. He was very happy to hear that there were others like mine and agreed to come by the office and pick up the information.

I called a listing agent on one that I thought would be of interest to him only to be told that I wasn't qualified to sell her listing...WOW!!!

A little background on me and my market.  I have been a Realtor for about a year and a half, granted not the most experienced in my market, but am proud to boast that I am in the top 25 in my market of over 200 agents.  There is not a large commercial market in my area, and most agents list and sell a little of everything.  I have sold 3 commercial listings so far and am happy to say that they all went well.   There is no call for a commercial real estate office or branch in my area. 

She told me that there are only 2 agents, including herself that was qualified to sell the property and that she would be happy to take the buyer and give me a referral fee...

I looked up the stats and see that the property has been listed for a while, and wondered if this is because she is not willing to let "just anyone" sell it...

Just so happens that I have the sellers personal home listed and was able to get any information I needed to write an offer if I need to..and of course she would be obligated to present it...but here is the question--

Have any of you refused to give information to a buyers agent because of their qualifications? 

Have any of you been rejected by an agent because you didn't have the experience that they thought would be sufficient for the deal?

I had a similar experience during my first year.  I called another realtor about a listing and was told that unless I had done ____ number of sales of this type, that the co-broker amount would be less than what was stated.

I don't know that your experience or lack thereof had any bearing on the listing agents' action. 

I'd take it to my broker and ask my broker to present.  That should clear up the "experience" excuse. 

I've called on luxury properties only to be told that they would be glad to "show and pay me a referral fee". Sure, I bet they would.

In residential, the matter of agency is very much involved.  But, not so much in commercial.

It's a shame but she'll probably get by with it.

Wow, she really has a high opinion of herself doesn't she? How did she learn how to be one of the two agents "qualified" to sell the property. We all have to start somewhere, I would write the offer, and expect a little more respect from her the next time I spoke to her.

I have never heard of such a thing.  How does she know how qualified you are?

I know of agents that have been in the business for decades that are idiots or unethical or both.

I have never had this happen to me, nor would I do this to an other agent, but I have heard of this happening in our area. I wonder if the seller's of the agents that are doing this are aware that the LA are turning away potential buyers?

I'm really wondering about the ethics of this approach.  Isn't it the listing agent's responsibility to make every effort to sell the listing, and isn't turning away a prospective buyer on this basis (and trying to "poach" the buyer at the same time) unethical? 

It will be interesting to see what others have to say on this one.

Hi,

Welcome to the wonderful world of commercial real estate.  Without trying to offend any commercial brokers out there, this is pretty common place, just like their pocket listings, and no info listings, and must be qualified listings, and on and on.  To put this person in his or her place, refer it to your broker, and make sure he explains "the offer to cooperate" by listing it in the MLS.  That should cool their heels for awhile, and if it doesn't, have your broker ask to speak to their broker.  Good Luck!...Sounds like you have a prim-donna as a listing agent.  Let me know how you make out please

The last time I checked we all had to get our License from a State recognized authority.  Caller her broker... she has an obligation to present all offers, so is she breaking that rule by upfront telling you that you can't sell it ???

Never happened to me, Shari - I feel badly for you. Sounds like you have enough under your belt to do what you need to, plus you have the experience and knowledge of your broker (who is ultimately responsible).

Well, My broker and her broker spoke today..It seems like the listing agent has quite the rep of being that way...both brokers said not to worry about her, if I had a buyer, bring the offer!! 

I am surprised that that happens with luxury homes as well, to me a home is a home no matter what the price and how many options it has to offer...

I am glad to know that I am not the only one who thought this was rather odd!!

I don't even think its legal.  If you write an offer she must be obligated to present it.  What a sorry human being.  I would think her client would feel differently too.  I would file a complaint.
