She/He Who Finds The First House We Like Gets The Commission

Buyer's Agents work their tails off to find their clients the home of their dreams. They spend countless hours searching for homes online and previewing homes without you so your time is not wasted.

So, when you tell us you don't want buyer representation you mean the following:

  1. You don't want us to research area home sales in order to get you the lowest price possible.
  2. You don't want us to negotiate for you to get you the lowest price possible.
  3. You don't want us to give you information that we find out by accident that could get you the lowest price possible.
  4. You don't want us to tell you anything that could get you a lower price.
  5. You don't want representation during the home inspection and when something goes awry, you want to be on your own.
  6. You don't want our services for free.
  7. You do want us to run around viewing homes before showing them to you because you do not want your time wasted.
  8. You do want us to take you to Open Houses on the weekends and fore go our personal time.
  9. You do want us at your disposal no matter what.

Without buer representation, #1 through #5 you will get without a doubt. Without signing the Exclusive Buyer's Agreement, all Realtors work for the seller, period. We can't do the 5 steps above. We can't do anything that could prevent the seller from getting the highest price possible. The law says we can't and we don't.

Buyer's Agents will do everything humanly possible to find you that dream home and keep the deal together when things go wrong. They will be in your corner all the way.

Most Realtors do not like it when they are dealing with a buyer who wants to work with other Realtors at the same time. We all have access to the same homes you see online. We know that after weeks or months, you will call letting us know you found a home through another Realtor and thank us for our efforts.

Realtors are professionals. We know our markets. We are knowledgeable. We will break our back to find you that perfect home. We know real estate laws. We have respect for ourselves and our profession. We take ourselves seriously and so should you.

Yes, you have a choice. You can work with as many Realtors as you want or not. Realtors also have choices. Most of us will not play the "first Realtor who finds me a home gets the commission" because we have self-respect. Real estate is our livelihood, not a game. Treat us the way you expect to be treated.

Hi Lane, I can understand a consumers position and I'm sure everyone else can. We are all consumers. I understand the lack of trust in the beginning. We work under managing brokers and if we literally mess up ethically, they can also cut us loose. Most times this can make a buyer feel more at ease.

Ralph in # 115:  I have been an agent in the Fort Worth area for nine years... and I have never heard of an agent getting a retainer fee for being a buyer's agent.  It sounds like a great idea, but I cannot think of any buyer who would go for it.  Perhaps commercial buyers... but I don't know anything, really, about commercial real estate.

No one does it here in Birmingham, either, but there are some places where it is done.

 

I do not transport buyers in my car.  There are several reasons for that, but an added benefit is that those who are just looking or working with someone else seem to only want to use my gas

Hi Ralph, I can't imagine buyers giving a retainer fee. What happens if they do not purchase a home? What are the stipulations?

From talking to agents from those areas, it all depends.  For the most part, it is treated like earnest money.  If they do not buy a home through no fault of their own, they get it back.  That said, there is some sort of reasonable effort expected. 

I had a client last year that I helped forever.  FOREVER.  We started in one part of town and ended up on the other.  We viewed around 200 houses.  We did write offers, four of which were accepted.  Of those four, three failed the home inspection in ways that cannot be described here (and were not visible to the untrained eye).  On the last one, he had a change in job description that messed up his financing.  Now, had he paid a retainer, in my opinion, he would get it back.  We both made great efforts to find him a home. 

Three years ago, I had another client who wanted to view homes every weekend.  Before we set foot in the field, I did a major interview.  They were able to buy, had money to cover the cost of closings and moving, and needed more space.  They did not have a home to sell, as they were renting from some of their family.  Anyway, after we looked at about 20 houses, some leading questions turned up information that I had missed before (and have since changed my interview).  They had been looking for about a year, and had no real intention of buying, unless that perfect house appeared.  Now, they would lose that money.

In the end, if they had a chance to lose money in the process, the game-playing would end.  It would never work here, though.  The second one person asked for it, everyone else would advertise no fee buyer agency

Hi Ralph, The no fault of their own makes sense. The first thing I ask if they have been pre-approved for a mortgage. Most sellers won't even entertain an offer without one unless it's all cash. I tell buyers this upfront. If they do not want to get pre-approved then that tells me they are not serious along with asking other questions.

That has become the third thing that I ask.  First, I ask why they want to buy a home.  Second, I ask if they have had any contact with any other real estate agent.  THEN I check on a loan.

 

You are dead on it about the loan, though.  Unless they are  a cash buyer (in which case most sellers will still want a statement from their bank to proove it), if they will not start there, they will not start with me.

I personally do not work for free and I don't advocate anyone else working for free either.  I always use a Buyer Agency Agreement......especially with friends.

It looks like this thread is moving towards a discussion of  retainer fees for buyers.

The buyer broker agreement that I use in Florida has a paragraph addressing that as well as minimum commissions. I have routinely used the minimum commission paragraph when a customer is looking for low priced property. I have encountered little opposition. I have just started to use the retainer with customers that insist on making lo-ball offers that have little chance of success. I have a two strikes and you are out policy, ie Ill make two lo-ball offers for a client without a retainer. (Ive been surprised before when one of these is accepted) but the third offer will either be at the price I suggest or I want a $1000 non refundable retainer.

Jackie it sounds like a lot of work for a slow market.  On the other hand, I do know what I want and I'm not getting enough of them.  I have been buying short sales but can not get enough Listing Agents to work with me.  I don't need one I want them all.  If you can understand volume, then you can understand where I'm coming from.  Any 3/2's with finished basements or 4/2's.  All cash paid.  Don't work so hard for one, work less for many.

Hi Damon, I think all of us agree we do not work for free. Consumers have the right to work with 1 agent or many. We know that is not in their best interest.

Hi Ron, I have never heard of a retainer. I wonder how many buyers would balk at that one :) I should talk to my broker about that. Sounds like a good policy you have with the strikes.

Hi Herbert, working with investors is a different area for me. I see why you are going to work with different realtors because I'm sure they are all from different areas/towns, etc. One investor I'm working with wants one town and is looking for Legal 2 by CO. Those are hard to come by. He knows when one crops up, I will be previewing that home and taking pictures for him and then he will decide if he wants to see it. I have no problem with that because he will purchase a home through me and he knows how hard I work on his behalf. And he is all cash as well. So because of his tight requirements, I'm not out all day running around like a chicken, lol.

Hi Sara, thank you. You said it best. We work for free until we receive that check in our hands. Now, if something happens where our buyer-client has to stop their search, we can't help that. Life happens. I find more buyers wanting to work with multiple Realtors than not. I'm a magnet :)
