The Truth Some Real Estate Agents Don't Want You To Know

I overheard an agent on the phone the other day.  Someone wanted her to "run over and show her this house." 

The agent said "Why would I do that?  You aren't my client.  Sure, I could show you the house but I'm representing the seller.  You need to find an agent to represent you.  What if you like the house, then what?  You'd have to go out and find a buyer's agent to write the offer. You don't want me to write it for you, do you?  Remember, I represent the seller.  Go find an agent to represent you, let them do their job, and they'll call me if you decide that's the house you want to buy."

This agent is one of the most outspoken people I know.  She was being honest and giving good advice.  It may sound blunt to some but she was actually telling the potential buyer what was in his best interest.

Why would a real estate agent not tell you this when you call on the phone to see one of their listings?  In most cases, it's because that agent is hoping to collect both sides of the commission.  It doesn't change the price of the house but it affects your interests.  In some cases, it's because the agent knows they will get better terms for their seller if the buyer is not represented.

 

The agent representing the seller expects the agent representing the buyer to adhere to the rules.  They have assured their seller that only qualified buyers will be shown into their home.  Real Estate agents in Kansas City have signed agreements with Heartland Multiple Listing Service (MLS) and Centralized Showing (CSS) that stipulate they will show only qualified buyers into listed homes.

Not all real estate agents will be as forthright as the one in my story.  Use this knowledge to your advantage.

The only time I've ever heard of this is when the seller requests that the listing agent be a sellers agent only.  I have no problem being a disclosed dual agent.  I disclose the fact in the beginning and if the buyer isn't comfortable, I have no problem.  What I do find strange is when buyers insist on using the listing agent because they think they will get a better deal.

Wow! If that's not throwing something away, I don't know what is??  Why not refer them at the least to someone else in your office...Maybe they won't like that house and buy another, and you could represent them in that...I cannot believe she would do that and not at least try to qualify them!

Katherine, yes some buyers still believe that they will get a better deal by using the listing agent.  Dual agency is not legal in KS; it is still legal in MO; it is not allowed at our brokerage. We do have the option of converting to a transaction broker agreement.

Shane, yes, referring is usually the way if you can't take another buyer client.  Apparently this particular caller wanted to see houses before getting qualified.  None of the agents in the office at the time wanted to show homes to an unqualified potential buyer.  Most of us meet with our buyer clients in the office first, qualify them, go over the buying process and agency disclosure required by law, find out what their needs are, and then set up showing appointments.

I feel there is always have a better transaction for both my Buyers and Seller when I am working with both sides.  YES ... we have to disclose and know our boundaries, however I feel confident the buyer would get better service from working with the person who had direct contact with the seller.  Seller never have a problem with I sell there properties myself, nor do the buyers if they fee I was fair to them and gave them great service :)

My referral partners and I agree to not show homes to buyers other than qualified buyers.  Not only are you doing a disservice to the sellers when you don't take the time to make sure they are qualified, you could be wasting an abundance of time.

I've only not referred a buyer out twice. Both times they were on owner financing deals where they had already gone through 5 or 6 agents that clearly did not know what they were doing and they were best served by me actually doing both sides of the transaction because I was an expert in owner financing when no one else was doing it.
