OUR FREEDOMS AND RIGHTS

By
Real Estate Agent with Century 21 Birchwood Realty, Inc.

With all the talk about the Constitution, and whether it is being adhered to by this administration, I started considering how many of us really know what is in it.  I know we spout off about our freedoms, our right, and when we think they are being infringed upon, but do we really know what it says?  So in an effort to "practice what I preach" I decided to read it last evening.  To my surprise I found it much easier to read than I had imagined, it's not very long and lays out our governing laws quite simple.

Here are the two Articles, in this wonderful document, I feel address some of the concerns expressed.

Article II Section 1.    Before he enter on the Execution of his Office, he shall take the following Oath or Affirmation: - "I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my Ability, preserve, protect and defend the Constitution of the United States

Article IV Section. 4.   The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened), against domestic Violence

Article IV could be used to explain Arizona's new law to protect itself against "domestic Violence".  Whether you agree, or not, with Arizona's new law they are guaranteed by the Constitution to defend themselves if the Government of the United States doesn't.  I don't think anyone can deny the level of violence and kidnapping that has been increasing in that state, or deny the border issue is the main cause.  This could be interpreted as the "Invasion" part of the Article (it may seem extreme, but it is an interpretation).

Article II goes to the heart of the issue; if Article IV is not being upheld than Article II is in question on this situation alone.

If you feel the President is taking us from a Republic form of government to a Socialistic form of government than Article II Section 1 could also be in play.

CONSTITUTION

I have added this link to a copy of the Constitution for your reference.  Please read it, everyone should know the freedoms and rights they have, and what they are talking about when they refer to the actions of our government, states rights, and the preservation of the laws that have made us the great country we are.

The interpretation of these Articles are my own opinions of how they could be applied to certain situations going on today.  I am sure there are many different interpretations out there.

Lois,

Great post. I would add that Article IV, Section 4 addresses what Arizona is doing and what the federal government is supposed to be doing - protecting against Invasion (illegal border crossings). :)

Our rights/freedoms have been being chipped away at for decades.  In fact, my last post also was on yet another bill the Senate passed recently doing more of the same.

It's time to rise up.... and have an uprising... before it's too late and we're all slaves of the government,

Hi Steve - I thought I had include Invasion, sorry if I wasn't clear.  I am sure Arizona feel like that is what is happening.

Tammy - I agree with rising up but lets rise up and get to the polling centers, talk to our friends and colleagues, write to our representatives, and stick together as a united voting block.  I would hate to have our miltary, which is full of our sons and grandchildren, have to make the choice of who they fire on, their government or their parents. I understand where your coming from, I'm just not there yet.

I would love for those that disagree with the AZ law to mention exactly what power in the law isn't already part of federal law...

You know Lane, I don't think most of the people who are against the new law really know what it says; their first reaction is to think it's a new prejudice against them.

Lois this was a great post and I certainly agree with all you said. Specific to Arizona though I have an idea. If Obama and Mexico don't like the law that Arizona passed then how about we just adopt Mexico immigration law. What would those 2 say then?

Great idea Walter - since Mexico's laws are much more stringent than ours we would definitely have a more secure border.  I like it.
