I have just finished my third listing presentation.

 I am told that I need to have the seller write out the disclosure forms in his or her own handwriting. Does anyone else do this? Another question I have is when dealing with someonewho has the Power of  Attorney for an elderly client what if any special considerations are there?

I'm curious about how everyone else handles these issues. Somehow I don't remember going over any of this in the basic practice course!

I do not fill out the disclosures, ever.  As far as POA goes, I require a copy before undertaking any work.  Last thing you want to do is find out too late that the person signing the agreements and ultimately needing to sign the closing docs, does not have the authority to do so.

Raymond it it best to have the seller do the state property disclosure themselves.

Raymond, I highly recommend that you have your broker guide you throughout these processes.  That is what he/she is there for.   By all means, ask away here, but keep in mind we all come from different states with different rules and guidelines.  Congrats on the appointment

Raymond, in MIchigan we do not ever write on the Sellers Disclosure, even the address. Ask your broker and by the way. WELCOME to Activerain !!

Always remember that the seller disclosure is what the seller knows about the property. If for some reason the buyer decides to sue the seller about a non-disclosed item the seller disclosure form is the sellers only defense. SO let the seller fill it out. It is their behind. Remember to advise them to disclose anything that may be a concern for the incoming buyer. ANYTHING...

Check your title for a typo.  Seller filling out the disclosure is the law in many states.
