How many times have you finally heard the angel choir singing when you finally get that written approval from the bank, only to find out after all this time that the buyers have changed their mind for no good reason?

I personally think that there should be something in addition to the short sale addendum that penalizes the buyer for walking without a good reason.

We really need to do something to stop the behavior from buyers that a short sale is a "disposable" transaction.  It really bothers me, even in general, when buyers think that they are above the legalities of a real estate transaction.

And especially in the case of a short sale, this kind of fickle behavior is putting the seller, who has gone through the mill with submitting everything that the banks required, to having their home foreclosed upon when they were following all the guidelines for the short sale.

What are your thoughts?

Unfortunately it is what it is.  The buyer cannot be forced to stay in a deal.  After all, the only thing we have is a piece of paper that the buyer is saying "I think I want this house but I am not tied to it if I decide I do not want it" or something like that.  It is frustrating when the buyer walks after a lot of work, time and money has gone into getting that deal "approved".  There are after all only two principals the seller and the buyer.  The only say the lender has is if they want to play or not.  If the buyer walks then that is their decision and we can do nothing about it.  By the way what if the seller decides they want to do something different?
