If Home Grown Marijuana Becomes Legal What Will Landords Do?

California may well vote to legalize marijuana growing for personal use this November.  That creates a situation where landlords will have to deal with what they think about having their tenants growing the drug in their back yards, garages, and inside the home.

In my book it is the same as allowing a tenant a pet or allowing a tenant to smoke inside the unit.  We landlords can limit or deny pets (unless they are seeing eye dogs or companion animals) and we can deny a tenant the right to smoke inside the property.

So, I think we should be allowed to deny the tenant the right to grow marijuana in or on a place they rent.  I know I do not want marijuana on property I own, certainly not in a plot in the backyard or in the living room.

Hopefully, marijuana growing will not become part of a protected class.

Wow Robert - You hit on a very big question!  If it's legal, than I suspect much would have to do with the temperment of the landlord.  I remember showing property a few years back to a deputy sheriff.  We went into a rental house, and I noticed lights from a closet were shining through louvered doors.  When I opened the doors, there on a neat little shelf, were a half dozen plants growing very well within.  The deputy (off duty of course), said, "We didn't see that!"  I immediately let the seller know however, and the tenant was quickly vacated.

BUT, that was all in the days which "legality" wasn't even hitting the human consciousness:-)
