The number of homes being offered as tax lien foreclosure sales has risen in the past few months in Florida. However, the issue is not the center of current housing market news in the state, but foreclosing banks' actions are.

An example involves one of the many foreclosed homes in Broward, FL owned by Joyce and Dennis Brown. According to the couple, CitiMortgage has started foreclosure proceedings on their Lauderdale Lakes house by using fake documents. The Browns also accused CitiMortgage of failing to credit them with the payments they provided to the bank.

Although the case was later withdrawn by the bank and its lawyers, some attorneys who represent troubled homeowners have stated that a big number of foreclosed homes in Florida ended up being so because banks use fraudulent documents and other techniques that are designed to deny homeowners' rights to due process.

A number of lawyers for borrowers have also stated that a big number of homes should not have ended in foreclosure properties listings, but since some homeowners are unfamiliar with the true legal details of the foreclosure process, they get defeated by banks and some even do not get a chance to defend themselves.

With the number of tax lien foreclosure sales, government and bank foreclosures continuing to increase in Florida, analysts have stated that fraudulent actions by lenders should be addressed immediately to prevent further decline in the state's housing market. According to them, thousands of homeowners in the state might have lost their properties, not because of loan delinquency, but because of improper conduct by banks and lenders.

Because of increasing complaints from homeowners and their lawyers regarding the use of fake documents in the filing of foreclosure cases, several law companies that represent banks are being investigated by the state's Attorney General's Office. According to sources from the AG Office, some law firms might have used fabricated papers to hasten the process of foreclosure and take over homeowners' properties.

Meanwhile, some of the lawyers involved in the law firms under investigation have argued that there have been no fraudulent actions and that such problems might have stemmed from some clerical errors that they claim are inevitable due to the huge number of bank foreclosures and tax lien foreclosure sales.
