I withdrew a short sale listing today. I couldn't be happier!

I listed a home this past week in Bradenton, and really she didn't want to sell it.  Those are the toughest appointments.  It's one thing when the seller wants to move, or has too.  But when a seller really loves their home having to put them on the market is not pleasant.  In Bradenton and Sarasota foreclosures and short sales are now accounting for more than 60% of the transactions.  If we can lower the amount of people having to list that would rather stay it will help stabilize the market's downward path.

After seeing her situation a loan modification really made a lot more sense for her.  She was previously denied, but I encouraged her to "try one more time".  Since the new HAFA and HAMP program. I thought it was worth a shot.  She had two liens, and had been denied on two prior attempts due to insufficient income to qualify.  Well, my answer was to try again based on what her income really is, and with a clearly stated hardship try again. 

To her, and her attorney's surprise, they approved a loan modification that put the arrears at the end of the loan, lowered her interest rates to 2% interest only, and 4.5% fixed thereafter.  WOW! 

 I am glad that this one fell through, for her sake.  Her payment is now lower than what she would have spent to rent an inferior home.  The neighbors are happy since this means one less short sale or foreclosure pulling down property values in her Bradenton, fl home.

If you are facing financial hardship, and you want to keep your home my advice is you fight for it.  Right now in Sarasota and Bradenton there are over 26,000 homes in some stage of foreclosure.  If you want to get a loan modification keep at it.  Common sense says that banks like chase get a benefit from doing a loan modification versus a foreclosure and even a short sale.  Sometimes we all jut need a little confidence

Here is her note that she left on my facebook.

And... great for you for pushing them to try one more time. You didn't make any money, but gained something worth even more.

I cringe at "interest only" loans. I'd love to hear details on the terms of that loan. (for you to be happy about it?)

My thought is unless they plan to never sell & die leaving it to the state (no aires) "interest only" stinks!

Definitely, saving families from losing their homes no doubt is great.  But putting them in the long term financial position of being upside-down with an interest only???  Surely, that's not what you're speaking of in this example... can you share please?

I should say short sales are my niche (I have one hair left & continue to seek them out)  LOL I'm a die-hard advocate with a fool philanthropic nature that causes me to try to beat this dead real estate/foreclosure horse. Save the community yada yada... (that's how I got all these kids..It all started with adopting kids from the county)  LOL

ok back to bizzzz...

I asked for the explanation so if this is viable in my mind I could offer something along this line as well. But, to date, in my mind, interest only is suicide.

The first thing we should do is recommend a seller obtain advice from their accountant and attorney. If they advise a short sale then we do it. If they advise a work out, then they do that.

Thanks for your comments.  I will email you too, but thought my response should be included here as well.

I don't agree with your take on "interest only is suicide".  While I agree with your concern about the principle never decreasing. 

On a typical 30 year mortgage there is so little principle reduction in the early stages.  As for the particulars on her modification the key was getting her missed payments put on the back end of the loan.  Not increasing the principle balance, jut extended the term to cover those payments.  Interest only for a year gives her some breathing room to be able to save, and get back on track. After the first year the payment increases, and eventually this will convert to a regular principle reducing mortgage but not for 5 years. 

In the near term, her payment is reduced below what she could rent a home comparable to this.   So this is a good deal for her.  If she is "renting" from the bank or a homeowner what does it matter?

Hopefully after someone has had 5 years they will either be making more money, the market will recover so they can sell and not be negative.

I think that long term mortgages are a bad deal only made tolerable by the interest deduction offered by our goverment.  If that deduction went away (as it has bee discussed by washington) that could be a game changer.  15 year mortgages make much more sense.

If prices continue to plummet no one will need a mortgage anyway, since we can just pay with cash or a credit card!

Bill,  I ALWAYS have my sellers meet with an accountant and/or attorney to go over the potential consequences of a short sale/ foreclosure.

That's a great story. And it is nice to know that miracles still happen. A bank actually doing what they are supposed to do! WOW.

And, don't worry about all the "negatives" you hear. Solving today's problems today is what counts. All the old rules are of no value if someone looses their home.
