The other night I cried as I watched the movie ‘Letters to Juliet’ (yes I can admit it). Or maybe I was cutting up onions!!. Then a day later, I was ecstatic at how well Eminem portrayed himself in his hit movie ‘8 Mile’.
This was only from watching a movie. Many family’s go through emotions like this daily if not weekly. And from these emotions we all react in some way. More often than not – while I’m speaking with family and fans alike – I’m asked when is a good time to create an emergency estate plan? So, I honestly tell them, as soon as you can.
At a recent conference I spoke at I related the story of a 42 yr old real estate professional, client, husband and father of 3. And how he passed away from a heart attack, no plan in place and now has left his family with an uphill battle.
Here’s one I get often: “don’t worry my niece/nephew/neighbor/clown-we-hired back in the day is a lawyer and we get “free advice” about creating a will, power of attorney, medical power of attorney, or trust.”
How many family functions do you think the conversation came up? Or another story by a client whose evil sister ended up stealing more than $287,876 from Mom’s bank account. And Mom had a Will.
Here are 3 easy steps to decide if you should be listening to family members’ conversations for you and your family at your next holiday gathering.
1. If you fear the State raising your kids, this is your time to get an emergency estate plan in place (A will is not enough to keep the state from raising your children by the way).
2. If you fear an evil step-child suing your wife if you pass on, you need get off your $%@ and get the plan done.
3. If you fear your loved ones, children, beneficiary’s from inheriting your mortgage, credit card and other debts when you die.
The last item, is the best indicator in my opinion since many homes are under water with large mortgage’s. What will happen if instead of receiving your insurance proceeds, retirement plans or other hard-earned assets your kids now get a bill from the mortgage company?
